The draft Decree on the organization and operation of villages and residential areas; and the regime and policies for part-time officials in villages and residential areas consists of 4 chapters and 16 articles, specifically as follows:
Chapter I. General Provisions, comprising 3 articles (Articles 1 to 3), stipulates the scope of application; defines the location and nature of villages and residential areas; and outlines the principles of organization and operation of villages and residential areas.
Chapter II. Establishment, arrangement, reorganization, dissolution, and naming/renaming of villages and residential areas, consists of 5 articles (from Article 4 to Article 9), stipulating the principles, criteria, and cases for establishment; the procedures for establishing, dissolving, naming, and renaming villages and residential areas.
Chapter III . Number, titles and regimes and policies for part-time personnel in villages and residential areas, consists of 3 articles (from Article 10 to Article 12), regulating the number and titles; allowance fund, training and professional development regime, social insurance, and health insurance for part-time personnel in villages and residential areas.
Chapter IV . Implementation and Enforcement Provisions, comprising 4 articles (from Article 13 to Article 16), stipulates the funding sources for implementation; transitional provisions; responsibilities for implementation; and effective date.
Criteria for establishing villages and residential areas
In the draft, the Ministry of Interior has set out specific criteria for establishing villages and residential areas, taking into account the characteristics of each locality.
1. Number of households
a) In Hanoi and Ho Chi Minh City: a village must have at least 500 households, and a residential area must have at least 700 households;
b) In the Northern Midlands and Mountainous regions: villages must have at least 150 households, and residential areas must have at least 300 households;
c) In the Red River Delta region: a village must have at least 400 households, and a residential area must have at least 550 households;
d) In the North Central region: villages must have at least 350 households, and residential areas must have at least 450 households;
d) In the South Central coastal region and the Central Highlands, villages must have at least 350 households, and residential areas must have at least 500 households. Specifically in Gia Lai, Lam Dong, and Dak Lak provinces: villages must have at least 300 households, and residential areas must have at least 450 households. households or more;
e) In the Southeast region, a village must have at least 400 households, and a residential area must have at least 550 households;
g) In the Mekong Delta region, a village must have at least 400 households, and a residential area must have at least 550 households.
2. The scale of the number of households for villages and residential areas with specific characteristics.
In cases where villages or residential areas are located in border regions or islands far from the mainland, due to migration or for the purpose of protecting the border and maritime sovereignty; or in areas with other unique characteristics (where the terrain is fragmented and complex; located in isolation on islands, islets, or sandbanks in rivers, etc.), the size of villages or residential areas may be smaller than that stipulated in Clause 1 of this Article.
The provincial People's Committee shall specify the scale of the number of households for the villages and residential areas stipulated in this clause, in accordance with the conditions of each locality.
3. Other criteria
Villages and residential areas must have essential socio-economic infrastructure, appropriate to the local conditions, to serve community activities and ensure the stability of people's lives.
Decentralization and delegation of authority in the establishment, arrangement, naming, and renaming of villages and residential areas.
Regarding the authority to establish, reorganize, dissolve, name, and rename villages and residential areas, the Ministry of Interior proposes the following regulations:
1. The People's Council of the ward decides on the establishment, arrangement, reorganization, dissolution, naming, and renaming of residential groups within its jurisdiction.
2. The People's Council of the commune decides on the establishment, arrangement, reorganization, dissolution, naming, and renaming of villages within its jurisdiction.
3. The People's Council of the special administrative region decides on the establishment, arrangement, reorganization, dissolution, naming, and renaming of villages and residential areas within its jurisdiction.
4. In areas where there is no local government at the commune level, the People's Committee of the commune decides on the establishment, arrangement, reorganization, dissolution, naming, and renaming of hamlets and residential areas within its jurisdiction.
