According to some experts, the proposed legal regulations are considered a breakthrough, but they could also be a bottleneck. This is because if the regulations are appropriate and practical, they will encourage and create momentum for development; conversely, if the regulations do not keep pace with reality, they will hinder development. Therefore, the Central Government is currently focusing on reviewing and immediately removing bottlenecks, especially regarding regulations that closely reflect real-life situations.
Speaking at a recent working session between the Government delegation and Bac Giang province, several provincial representatives made relevant suggestions and proposals. One representative noted that during the construction of urban and residential areas in the province, many commercial and service land plots (clean land) have been created. Many large businesses and corporations have come to explore investment opportunities and expressed interest in investing in Bac Giang. However, putting these land plots into use to form commercial and business centers is facing obstacles due to land law regulations.
Specifically, the 2024 Land Law stipulates that these cases are not eligible for the one-time payment land lease method (except when the project includes land for tourism , office, or accommodation purposes). Meanwhile, the auctioning of land leases with annual payments is not yet defined in this Law. Furthermore, if every service land area is designated for tourism, office, or accommodation businesses, it will limit and stifle the variety of services offered.
To promote the development of service industries, Bac Giang proposed that the Government allow the use of clean land through auction with a one-time land lease payment method to attract potential businesses to the area, creating a shift in service sector development.
In addition, within the province, there are many projects implemented through land use rights transfer agreements, but after many years, they remain unfinished and unoperational due to unresolved issues with several plots of land located within the project area. We request that the Ministry of Agriculture and Environment provide guidance on resolving this matter.
Laws are enacted to create deterrence and increase strict enforcement, but some regulations create difficulties or are not in line with reality, leading to wasted resources. Understanding the situation from the localities, the Government's working group listened to and accepted suggestions with the spirit of providing specific guidance on legal provisions that are permitted, and for those not yet permitted but suitable to the practical situation, recommendations will be made to resolve them, using one law to amend multiple laws. This further demonstrates the determination to build a constructive, honest, effective, and efficient government.
