The government has just issued a Decree guiding the implementation of specific mechanisms and policies to resolve difficulties and obstacles for stalled and long-standing projects in accordance with the National Assembly 's Resolution. The Decree focuses on guiding the handling of projects that have been granted certificates improperly; projects violating regulations in investor selection, management, and land use; and investment projects on land that has been reclaimed by the State in violation of the law.
For projects that have been granted certificates improperly, the Department of Construction of the localities where the projects are located will take the lead in reviewing their conformity with the planning, compiling the dossier, and submitting it to the Provincial People's Committee for consideration and decision on adjusting the land use purpose or adjusting both the land use purpose and the land use duration. If the adjustment is approved, the project does not have to re-apply for the land allocation or lease decision.
The decree also stipulates the responsibilities of the Department of Agriculture and Environment, the Land Registration Office, land users, and investors in determining financial obligations, publishing the list of land certificates, posting public information, updating cadastral records, and issuing/exchanging land certificates.
This decree is a concrete action by the Government to address thousands of real estate projects nationwide that are "stuck" due to legal obstacles, including issues beyond the jurisdiction of local authorities and the Government, requiring a National Assembly resolution for thorough resolution.
According to the Ministry of Agriculture and Environment, as of March 30, 2025, the whole country has 4,489 projects and land funds facing difficulties and obstacles, with a total area of over 198,000 hectares and a total investment of over 3.35 trillion VND, equivalent to about three times the total public investment capital this year. If these issues are resolved, this resource will create a huge impetus to boost economic growth by over 10% in the coming years.
