Comments on the draft Law on Bidding (amended)

BTO - On the morning of May 4th, Mr. Nguyen Huu Thong - Deputy Head of the National Assembly Delegation of the province - chaired a conference to provide feedback on the draft Law on Bidding (amended); representatives from relevant departments and agencies of the province also attended.

The draft Law on Bidding (amended) consists of 10 chapters and 99 articles regulating state management of bidding activities; the authority and responsibilities of agencies, organizations, and individuals in bidding activities, contractor selection activities for bidding packages, and investor selection activities for investment and business projects.

Deputy Head of the Provincial National Assembly Delegation Nguyen Huu Thong chaired the meeting to gather opinions.

During the conference, delegates focused their discussions on the need to amend the Law on Bidding; the name of the law; its scope; the issue of direct contracting; methods for evaluating bid documents; the eligibility of contractors and investors; ensuring competition in bidding; forms of contractor selection; pre-bidding; contractor selection process and procedures; investor selection process and procedures; online bidding, etc.

Delegates argued that some aspects of the draft Law need further review and refinement to ensure it fully meets the set objectives. While amending the Bidding Law is necessary, it currently focuses too much on revising specific provisions and procedures. Therefore, delegates suggested eliminating bidding altogether to shorten procedures, save time, and avoid corruption and the tendency to evade responsibility. They proposed studying the implementation of competitive bidding with specific binding conditions. Some suggested more specific regulations on preferential treatment in bidding to ensure smooth implementation and maximize the advantages of being held in Vietnam.

Speaking at the conference, Deputy Head of the Provincial National Assembly Delegation Nguyen Huu Thong emphasized: The amended Law on Bidding is of great importance in resolving practical difficulties in procurement, investment, and contractor/investor selection. Therefore, it is crucial to ensure that the legal regulations are appropriate and promote social development. Open and transparent bidding activities will create a fair and healthy competitive environment among participating entities.

The Deputy Head of the National Assembly Delegation received the opinions expressed at the conference and compiled them for the Provincial National Assembly Delegation to submit to the National Assembly. The draft law is expected to be considered and passed by the National Assembly at the upcoming 5th session.
