Hanoi is innovating the procedures for establishing, adjusting, and expanding the boundaries of high-tech zones.

Continuing the agenda of the 22nd session, on the afternoon of April 29th, with a majority of delegates present voting in favor, the Hanoi City People's Council passed a Resolution stipulating the procedures for establishing, adjusting, and expanding the boundaries of high-tech zones and exercising certain powers of the Management Board of high-tech zones and industrial parks of the city.

The resolution comprises 7 chapters and 30 articles, clearly defining the scope of application, subjects covered, and procedures for establishing high-tech zones… In particular, Article 10 stipulates the procedures for granting and amending construction permits.

Specifically, the project investor submits an application for a construction permit or an amendment to a construction permit to the Management Board in accordance with the law on construction. Within 7 working days from the date of receiving a complete application, the Management Board conducts a site inspection and prepares a report documenting the current situation, and checks the application for a construction permit in accordance with the law on construction.

If the application dossier is incomplete, does not comply with regulations, or does not reflect reality, the Management Board will notify the investor in writing once to supplement and complete the dossier. If the supplementary dossier does not meet the requirements as stated in the notification, the Management Board will inform the investor within 3 working days of the reasons for not granting the construction permit.

If necessary, within 5 working days from the date of receiving the complete dossier as prescribed, the Management Board shall send a written request for opinions from state management agencies in fields related to the construction project. Within 12 days from the date of receiving the dossier as prescribed, the agencies consulted shall be responsible for responding in writing on matters falling within their management functions.

Article 13 stipulates the procedures for approving investment policies. Specifically, investors submit applications for approval of investment policies to the Management Board as prescribed. Within 3 working days from the date of receiving a valid application, the Management Board sends the application for appraisal to the Department of Finance and other relevant departments and agencies regarding matters within the scope of their state management as prescribed by investment law and other relevant legal regulations, and sends it back to the Management Board within 15 working days.

Article 21 stipulates the procedures for approving the employment of foreign workers by contractors. Specifically, before recruiting foreign workers, the contractor submits a dossier to the Management Board declaring the number, qualifications, professional skills, and experience of foreign workers needed to perform the contract in Vietnam, and requests the recruitment of Vietnamese workers for the positions intended for foreign workers.

If the contractor needs to adjust or supplement the declared number of workers, the investor must confirm the adjusted or supplementary plan for the contractor's labor needs. The Management Board will consider and decide whether the contractor is allowed to recruit foreign workers for positions that cannot be filled by Vietnamese workers, provided that no Vietnamese workers can be introduced or supplied to the contractor.

In presenting its verification report, the Economic and Budget Committee of the Hanoi City People's Council proposed reviewing the provision in Article 3 to state, "Hanoi City High-Tech Zone includes..." to distinguish it from the concept of "High-Tech Zone" as defined in the 2008 High-Tech Law, ensuring the unique characteristics of the Capital City.

Article 4 stipulates that the response time for relevant agencies regarding applications for the establishment of high-tech zones is specifically set at 10 working days. However, to ensure consistency and transparency in the timeframe for reviewing and resolving administrative procedures, the Management Board proposes adding specific regulations regarding the timeframe for the Appraisal Council to hold a meeting to appraise the application and the deadline for collecting feedback after the Management Board submits the application for the establishment of the high-tech zone for comments from the Appraisal Council members.
