Fake luxury goods 'look real' in China

VnExpressVnExpress15/03/2024

Chinese authorities said they have handled many cases of counterfeit LV bags and Alexander McQueen watches with "authentic" certification documents.

On the occasion of March 15 - World Consumer Rights Day, Yangcheng Evening News published an article about how manufacturers and sellers in China turn fake goods into genuine ones. Some customers accept to buy fake branded goods, while others are tricked into buying fake goods.

According to the article, when going to the Zhanxi shopping area in Guangzhou, consumers can encounter employees who specialize in luring customers to buy fake branded goods. Within 100 meters, there are about 10 people doing this job. They will lead customers to stores selling fake branded products, often hidden in office buildings to avoid control by authorities.

The trick of these counterfeiting lines is that when they see a luxury item that is selling well, the factories will buy the genuine item to use as a sample for mass production. The stores here sell all kinds of fake products, from all brands, such as Hermès, LV, Gucci, Nike, Adidas.

For example, the genuine Alexander McQueen watch costs 6,200 yuan (21.3 million VND), while the fake ones range in price from 160 yuan (550 thousand VND) to 380 yuan (1.3 million VND). Louis Vuitton x Nike Air Force 1 shoes are rare and expensive, but for only 380 yuan, users can own a pair that is exactly like the brand.

For 1,300 yuan (4.4 million VND), buyers can carry a fake LV bag, the official listed price is 25,600 yuan (88 million VND). It also comes with an invoice, a certificate of authenticity from a "Korean store". Buyers can even go online to look up the storage information and origin of the goods. The fake bag becomes "the real thing in a foreign store".

Authorities in this country have determined that the production line and the transformation of counterfeit goods into "genuine goods from foreign stores" are sophisticated and professional. The stores provide full documents including purchase invoices, user manuals, tags, boxes, and warranty cards. These "certificates of authenticity" are sold for 30 yuan (103 thousand VND).

In order to deceive buyers, the seller can collude with people in the logistics company to fake the delivery information. Therefore, a branded bag made in Guangzhou can become a "hand-carried bag" from a genuine store in Hong Kong, Korea, Europe and America.

Lawyer Liao Jianxun of a law firm in Guangdong said that under the Trademark Law, using another person’s trademark without the owner’s consent is a trademark infringement and may even constitute a crime. He urged consumers to report to the police or market management agency if they buy counterfeit goods.

According to Chenbao , in recent years, the police have arrested and handled many cases of using fake invoices to deceive consumers. Jiangsu police once arrested a girl named Tu for allegedly defrauding a victim named Vuong of 22,000 yuan (75.5 million VND). According to Vuong, because she believed Tu was an international student in France, she transferred money to Vuong to buy a limited edition Hermès bag. When she received the goods, she went to have the bag appraised and found that the bag was fake, so she reported it to the authorities. Tu said she bought the fake Hermès bag and the documents and shopping invoices online, and resold them to Vuong for profit.

Although Chinese authorities have cracked down on trademark infringement rings, counterfeit distributors are still rampant. On the one hand, both sellers and buyers have not yet firmly said no to counterfeit goods. On the other hand, with low production costs but high profits, production and supply chains do not miss the opportunity to make money.
