The Trump administration is implementing one of the most drastic immigration crackdowns ever, significantly restricting the ability to apply for a green card while in the United States, forcing most applicants to return to their home country to complete the process.

According to a new announcement from the U.S. Citizenship and Immigration Services (USCIS) on May 22, adjusting residency status for green card applications within the U.S. will now only apply in exceptional cases. This means that many foreigners currently studying, working, or temporarily residing in the U.S. will have to leave the U.S. to file their permanent residency applications from their home countries.

American media outlets have described this as the latest step in the Trump administration's strategy to tighten immigration, aimed at preventing foreigners from entering the country on short-term visas and then staying long-term through marriage or employment-based sponsorships.

USCIS spokesperson Jack Culler stated that non-immigrant visas such as student, temporary worker, or tourist visas are intended for short-term purposes and should not be used as a "stepping stone" to applying for U.S. permanent residency.

According to The New York Times, approximately 1.4 million people were granted green cards in the US in 2024, with over 820,000 cases processed through adjustments to status within the US. Under the new regulations, the majority of these cases will have to be processed overseas.

Experts warn that the new policy could significantly prolong processing times, as appointment backlogs at U.S. consulates in many countries are already months to years long. Those applying for green cards through marriage or family reunification also risk having to live apart from loved ones for extended periods while awaiting the decision.

The Wall Street Journal noted that millions of people could be affected by this change. Meanwhile, the Washington Post reported that some applicants, after leaving the US, may face the risk of not being allowed to return, especially if they come from countries subject to entry restrictions under previous Trump executive orders.

Since returning to the White House, the Trump administration has consistently pursued a tough immigration policy. Previously, the US also significantly increased the fee for the H-1B skilled worker visa, thereby considerably raising the barrier for foreign workers wishing to come to the US to work and settle.
