Numerous land-related violations in Dong Hoa commune.

On the morning of May 12th, the An Giang Provincial Inspectorate announced that it had issued a conclusion on the inspection of the implementation of policies and laws in land management and use by the People's Committee of Dong Hoa commune.

Dong Hoa commune was established on July 1, 2025, based on the merger of Dong Thanh commune and Dong Hoa commune, An Minh district, Kien Giang province.

Recently, the security and social order situation in Trung Hoa hamlet, Dong Hoa commune (the area of ​​Song Hau State Farm land handed over to the local authorities) has become complicated. Specifically, in 2024, disputes arose between households living in the area; these households submitted petitions and complaints to higher authorities requesting a review of the issuance of land use right certificates for the land in Trung Hoa hamlet, Dong Hoa commune.

Land confiscated in violation of regulations.

According to the inspection report, in 1985, Song Hau Farm (now Song Hau Agricultural Company Limited) collaborated with Kien Giang province to reclaim land for rice cultivation with an area of ​​approximately 105,488.9 m² (the actual measured area according to the current state of the land is 113,317.9 m²) in Hoa Dong hamlet (now Trung Hoa hamlet), Dong Hoa commune.

Around the end of 1986 and the beginning of 1987, Song Hau State Farm handed over the land to Kien Giang province for management. A review of archived records revealed no documents showing the transfer of this land area between Song Hau State Farm and Kien Giang province, nor any records indicating the transfer of this land area to the People's Committee of Dong Hoa commune or the People's Committee of An Minh district for management.

In 1994 and 2002, the People's Committee of Dong Hoa commune entered into land lease contracts with six households (the commune's land leasing was not in accordance with regulations), with a total area of ​​23,053 m² (out of the aforementioned total area of ​​113,317.9 m²); the lease term was one year. After the contracts ended, the commune's People's Committee did not allow the households to continue leasing the land but did not terminate the land lease contracts, and the households continued to use the land.

In 1994, Dong Hoa 4 Primary School (now Dong Hoa 3) was built (at this time there are no records related to the school's construction, the area is unclear) consisting of 2 blocks with 7 classrooms (completed and put into use in 1998), without a fence, boundary, or markers on the land left behind by Song Hau State Farm. During the management process, the school received investment and expanded construction (the procedures for land allocation and issuance of land use rights certificates have not yet been completed).

By 2007, Dong Hoa 2 Junior High School (now Dong Hoa 1) received investment to build a school campus with an area of ​​7,710m² on land transferred from Song Hau State Farm. Currently, the boundaries are still marked by concrete pillars used for the school's fence built in 2007 (the procedures for land allocation and issuance of land use rights certificates have not yet been completed).

On March 18, 2010, the Chairman of the People's Committee of An Minh District issued a decision to inspect the compliance with policies and laws in the management and use of land in Dong Hoa Commune. Following the inspection, the Chairman of the People's Committee of An Minh District issued a conclusion stating that in Hoa Dong Hamlet (now Trung Hoa Hamlet), 17 households had been granted annual land lease contracts by the People's Committee of Dong Hoa Commune, totaling 85,935.2 m². The land was to be managed by the People's Committee of Dong Hoa Commune and included in the commune's administrative area plan when a new commune division is planned, without considering compensation for the value of the land use rights. According to the conclusion, there was no plan to reclaim the land from these households. Furthermore, the examination of records and documents only revealed 6 land lease contracts with a total area of ​​23,053 m².

On June 22, 2012, the Chairman of the People's Committee of An Minh District issued a decision to establish a team to review the implementation of the aforementioned inspection conclusions. Following the review, the Chairman of the People's Committee of An Minh District issued a review conclusion, instructing the Department of Natural Resources and Environment to prepare procedures for issuing a decision to revoke land use rights for 15 households, covering an area of ​​99,600 m² in Trung Hoa Hamlet (formerly Hoa Dong Hamlet), for public purposes.

Following the conclusions of the aforementioned review, on September 14, 2012, the Department of Natural Resources and Environment advised the People's Committee of An Minh District to issue 15 decisions to revoke land from 15 households, citing the reason for the revocation as the implementation of the aforementioned review conclusions.

Upon reviewing the records, at the time the District People's Committee conducted the re-examination and issued the land revocation decision, there were 2 organizations and 20 individuals using the land, but only 15 individuals were subject to the land revocation decision, totaling 99,600 m²; while 5 households using a total of 8,360.1 m² had a similar land use history to the 15 households mentioned above, but the An Minh District People's Committee did not revoke their land use rights.

The Department of Natural Resources and Environment of An Minh district, in coordination with the People's Committee of Dong Hoa commune, has implemented 14 out of 15 decisions; however, the People's Committee of Dong Hoa commune has not followed the procedures for managing the reclaimed land area, and the 15 households mentioned above continue to manage and use the land.

In July 2020, An Minh district implemented a cadastral surveying and mapping project in the area, including Dong Hoa commune (to be completed and accepted in 2024). The survey of the current land use determined a total area of ​​105,788.9 m² comprising 28 land parcels, including 26 parcels with a total area of ​​94,631.8 m² currently used by households for various purposes (residential land, perennial crops, rice cultivation) and 2 parcels (managed by Dong Hoa 1 Secondary School and Dong Hoa 3 Primary School) with a total area of ​​11,157.1 m².

Currently, the entire area of ​​land mentioned above has not been allocated by any decision and no land use right certificate has been issued to any organization or individual.

The results of document review and on-site verification in the area show that from 2024 to 2026, there were 14 cases of house and construction violations related to land and construction laws. Of these, 10 cases were inspected, detected, and stopped by the Commune People's Committee, but no administrative violation procedures were initiated according to the law; the remaining 4 cases were not prevented or processed.

Furthermore, on-site inspections revealed cases where people transferred or gifted land using handwritten documents that did not comply with legal regulations, and some cases were under dispute.

Review the actions of individuals involved in the wrongdoing.

Based on the aforementioned violations, the Provincial Inspectorate concluded that the People's Committee of Dong Hoa Commune (before merger) and the People's Committee of An Minh District (before dissolution) did not follow the procedures to establish the right to manage and use public land of the commune as prescribed, and in reality did not manage the aforementioned land area. The entire 113,317.9m² land area lacked cadastral technical documents (maps, land registers, land registry books, etc.).

By July 2020, during the cadastral survey and mapping of the current land use by households, the People's Committee of Dong Hoa commune determined that the aforementioned area was commune-owned land; however, upon reviewing each plot and verifying the map and land register, it was shown that the Dong Hoa commune People's Committee was in charge of managing the land.

The fact that Dong Hoa 3 Primary School was built in 1998; Dong Hoa 1 Secondary School was built in 2007; and the Rural Water Supply and Sanitation Center, which was built and put into operation in January 2025, has not yet completed the procedures to be allocated land by the competent authority is contrary to regulations.

According to the law on inspection, there is no provision for reviewing inspection conclusions. Therefore, the An Minh District People's Committee's decision to establish a review team and issue a review conclusion is not in accordance with the law on inspection. Furthermore, the review conclusion instructing the Department of Natural Resources and Environment to initiate procedures for issuing land revocation decisions for 15 households is unfounded. This led to the issuance of land revocation decisions that were not in accordance with regulations.

The People's Committee of An Minh District issued 15 land reclamation decisions that were not in accordance with regulations. Furthermore, after implementing 14 out of 15 land reclamation decisions, from 2012 to the present, the People's Committee of Dong Hoa Commune has not strictly enforced these decisions, allowing people to continue using the land. There is now grounds for considering the recognition of land use rights according to current land regulations.

Regarding responsibility, the An Giang Provincial Inspectorate recommended that the Chairman of the Provincial People's Committee instruct the Chairman of the Dong Hoa Commune People's Committee to revoke 15 land reclamation decisions dated September 14, 2012, issued by the An Minh District People's Committee.

We propose that the Provincial Party Committee's Organization Department, based on Party regulations, conduct a review of individuals under its management authority; and we propose that the Chairman of the Provincial People's Committee assign the Department of Internal Affairs and the Department of Ethnic Minorities and Religion, based on regulations concerning cadres and civil servants, to advise the Chairman of the Provincial People's Committee on conducting a review of individuals under their management authority who are involved in the violations.

The Party Committees of Dong Hoa and An Minh communes are requested to conduct reviews of individuals under their respective jurisdictions in accordance with Party regulations. The People's Committees of Dong Hoa, An Minh, and Dong Hung communes are requested to conduct reviews of relevant individuals in accordance with regulations on cadres and civil servants.
