After 3.5 days of work, the 5th Extraordinary Session completed its entire agenda and held its closing session on the morning of January 18th.

At the session, the National Assembly demonstrated a high sense of responsibility, promoted democracy and wisdom, and frankly discussed, carefully considered, and voted to approve the following contents: the Land Law (amended); the Law on Credit Institutions (amended); the Resolution on some specific mechanisms and policies for implementing national target programs; and the Resolution on the use of the general reserve and the central budget reserve of the medium-term public investment plan for the period 2021-2025 for ministries, central agencies, localities, and Vietnam Electricity Corporation.

The decisions made by the National Assembly at this session are of great importance not only for the implementation of the socio -economic development plan for 2024 and the entire term, but also have fundamental, strategic, and long-term significance, demonstrating the spirit of legislation for the people.

The National Assembly has passed the amended Land Law, comprising 16 chapters and 260 articles, completing one of the top legislative tasks of the 15th National Assembly term in accordance with the 2013 Constitution, the Party's guidelines and policies, and directly the Resolution of the 13th Party Congress and Resolution No. 18-NQ/TW dated June 16, 2022, of the 5th Plenum of the 13th Central Committee of the Party.

The National Assembly's adoption of the Law on Credit Institutions (amended) at this session contributes to ensuring the safety, soundness, transparency, stability, and sustainability of the banking system and credit institutions, developing in accordance with the principles of a socialist-oriented market economy and common international practices and standards, enhancing competitiveness, and continuing to play a crucial role as a capital channel for the economy.

At the press conference, in response to a reporter's question regarding the recently passed amended Land Law, Phan Duc Hieu, Standing Member of the National Assembly's Economic Committee, stated that to ensure the consistent implementation of the Law in practice, the Government also submitted accompanying draft decrees to provide detailed guidance on its implementation.

According to preliminary statistics, there are approximately 65 articles and clauses that the Government is tasked with providing detailed regulations. However, the number of draft decrees is only an estimate, as this number may increase or decrease during implementation. Most importantly, the content must provide comprehensive guidance; one decree may provide guidance on multiple provisions of the Law.

Mr. Phan Duc Hieu expressed his hope that, after the Law is passed, the Government will soon have a specific plan to implement it, including determining the number of decrees to be issued, and which agency will be the lead agency responsible for drafting and advising on the decrees.

According to the Standing Member of the Economic Committee, the amended Land Law has many new points, focusing on five groups of issues.

Firstly, there are regulations aimed at better protecting the legitimate rights and interests of land users, such as expanding land use rights to Vietnamese citizens, including those residing abroad; and land policies for ethnic minorities…

The second group of issues concerns people's and businesses' access to land, such as regulations on land expropriation for the construction of socio-economic infrastructure and for production and business activities. This is a newly designed regulation, fully institutionalizing Article 54 of the Constitution, meaning that land should only be expropriated in cases of genuine necessity. In addition, regulations related to land negotiation mechanisms and land-use conversion for existing landowners should be expanded; land reserves should be increased; and land reserves should be allocated to small and medium-sized enterprises…

The third group of issues concerns improving land use efficiency, such as multi-purpose land use; narrowing down the cases requiring permits when changing land use purposes, etc.

The fourth group of issues concerns land finance, such as: separating land valuation from land-related support and exemption policies; and implementing policies to stabilize land lease fees, including input costs for production and business activities.

The final group of issues focuses on improving the efficiency and effectiveness of state management, including numerous reform regulations and the reduction of administrative procedures to facilitate convenience for citizens.

In addition, according to Mr. Phan Duc Hieu, the most important thing is to improve land data information so that people can easily access it to serve their lives, production, and business; and to have mechanisms that make it easier for people to monitor the implementation of land-related matters.

Answering a reporter's question about the significance of the Extraordinary Session, the Secretary General of the National Assembly and Head of the National Assembly Office, Bui Van Cuong, clarified: Extraordinary sessions and regular sessions have the same legal value and perform the same tasks and powers, falling under the authority of the National Assembly.

Furthermore, with issues that are already mature, clear, and have consensus, there is no reason not to pass them. Leaving the amended Land Law and the amended Law on Credit Institutions until May (7th Session) for approval would slow down development, especially national governance related to this sector.

"We have fully grasped the directives of General Secretary Nguyen Phu Trong at the first session of the 15th National Assembly term. The Chairman of the National Assembly has also consistently emphasized that: issues that are mature, clear, and proven correct by practice should be included in the law. New issues with differing opinions, if deemed correct, should be piloted, while issues with differing opinions that are unnecessary should be excluded," Mr. Bui Van Cuong stressed.

According to the Secretary General of the National Assembly and Head of the National Assembly Office, the amended Land Law and the amended Law on Credit Institutions were meticulously prepared, undergoing numerous sessions, meetings, and conferences for consideration and consensus. Issues that remained unresolved were not included and will be further considered through pilot programs before a final decision is made. The explanations, feedback, and revisions were also very convincing.

The percentage of votes in favor for the two draft laws accurately reflects their complexity and the meticulous and cautious approach put into their work.
