Identified as a new growth engine for the economy and a channel for disseminating national soft power, Vietnam's cultural industries have made positive strides in both market size and contribution level.

Numerous music concerts, creative festivals, live shows, films, and reality TV programs have generated significant revenue, contributing to shaping the national cultural brand and enhancing Vietnam's position on the international stage.

However, overall, Vietnam's cultural industry has not yet developed to its full potential, failing to form a sufficiently robust ecosystem to create sustainable value and long-term influence. One of the main reasons identified is the lack of a legal framework that is both consistent and specialized.

Although Vietnam has a Strategy for the Development of Cultural Industries until 2030, with a vision to 2045, the institutional framework for developing cultural industries remains fragmented across various specialized laws and falls under the purview of numerous different state management agencies. The lack of a unified coordination mechanism, as well as tools to encourage investment, cooperation, and human resource development in the cultural industry sector, creates significant obstacles in the development, exploitation, and commercialization of products. This is why many experts believe that a Law on Cultural Industries should be enacted, based on the industry's current development and drawing lessons from countries with developed cultural industries.


Recently, at a meeting with the Ministry of Culture, Sports and Tourism, Prime Minister Le Minh Hung directed the urgent drafting of a Government Resolution on the development of Vietnam's cultural industries and the research and development of a draft Law on Cultural Industries for submission to competent authorities. Resolution 80-NQ/TW dated January 7, 2026, of the Politburo on the development of Vietnamese culture also emphasizes the task of focusing on developing laws on artistic and literary activities, copyright, and the cultural industry... in a way that fosters and unlocks resources for cultural development.

The cultural industry encompasses a wide range of creative professions and involves numerous specialized laws such as intellectual property, tourism, cultural heritage, advertising, tax regulations, and e-commerce. Therefore, when drafting the Law on the Cultural Industry, it is necessary to ensure consistency and compatibility with existing legal regulations, avoiding overlaps or overly general provisions that are difficult to implement in practice.

The law needs to reflect the State's proactive role, paving the way for policies supporting the development of the cultural industry, integrating mechanisms to attract resources, especially those related to public-private partnerships, tax incentives, land, human resource training, the formation of funds to support creativity, and support for the export of cultural products, etc.


Along with encouraging and promoting creativity, the law also needs effective mechanisms to protect cultural products, especially in terms of copyright, to ensure that the creative environment operates fairly and transparently.

Along with specific regulations tailored to the unique characteristics of each industry, the law also needs to demonstrate leadership with the necessary openness to adapt to changes in technology and digital content, thereby creating a broad space for innovation…

With the cultural industry – a dynamic field rich in creative potential – if "paved the way" by a sufficiently strict and open legal framework, it will create genuine growth, contributing to the formation of a civilized cultural market with sustainable values ​​and rich identity in the flow of integration.
