After years of winning lawsuits against the District People's Committee and the school for a total of over 2.1 billion VND, six teachers whose employment contracts were terminated illegally are still waiting for compensation.
On October 16th, sources reported that Mr. Dinh Xuan Dieu, Chairman of the People's Committee of Krong Pak District, Dak Lak Province, had issued a document regarding the implementation of compensation for teachers whose labor contracts were terminated and the payment of court fees into the state budget.
Three out of six teachers won their cases after the first-instance trial.
According to the document, on October 9th, the District Civil Enforcement Agency issued a document regarding the enforcement of the order requiring the District People's Committee to jointly compensate teachers whose employment contracts were terminated and to pay court fees into the budget.
The District People's Committee seriously criticized the Department of Internal Affairs and the Principals of Nguyen Thi Minh Khai Secondary School and Ea Kly Secondary School for failing to comply with the previous directive to advise on and implement compensation for teachers whose employment contracts were terminated and to pay court fees.
The District People's Committee directed the Department of Internal Affairs to take the lead and coordinate with relevant departments and units to urgently advise the District People's Committee on the complete implementation of the two judgments of the Dak Lak Provincial People's Court.
The request is for Nguyen Thi Minh Khai Secondary School and Ea Kly Secondary School to promptly implement and fully execute the two judgments based on the provisions of the law and the actual situation of the schools.
As reported by Nguoi Lao Dong newspaper, at the end of 2021, Ms. Nguyen Thi Binh, a teacher at Ea Kly Secondary School (Krong Pak district), sued the school for illegally terminating her employment contract. The party with related rights and obligations is the People's Committee of Krong Pak district.
The court ruled that Ea Kly Secondary School and the People's Committee of Krông Pắk District are jointly liable to compensate Ms. Bình with over 175 million VND and pay insurance contributions from November 2018 to November 2021.
Similarly, in early 2022, five teachers from Nguyen Thi Minh Khai Secondary School sued the school for illegally terminating their employment contracts. The court ordered Nguyen Thi Minh Khai Secondary School and the People's Committee of Krong Pak District to jointly compensate the teachers a total of over 1.2 billion VND.
On October 9, 2023, the People's Committee of Krông Pắk district submitted a proposal to the People's Committee of Đắk Lắk province and the Department of Finance requesting an additional 2.1 billion VND to pay for the compensation of 6 teachers based on court judgments and court fees.
However, the Dak Lak Provincial Department of Finance stated that the teachers whose employment contracts were terminated and who won the lawsuit are not eligible for compensation under the Law on State Liability for Compensation. Therefore, the province cannot allocate funds to pay, and the District People's Committee must arrange the funds for enforcement of the judgment itself.
In late 2023, a leader of the Krông Pắk District People's Committee stated that the district would determine when the violations occurred and who was responsible, and then require those individuals to be held accountable for compensation. However, to this day, the six teachers who won the lawsuit are still waiting for compensation.
