After many years of winning lawsuits against the district People's Committee and the school for a total of more than 2.1 billion VND, 6 teachers whose labor contracts were illegally terminated are still waiting for compensation.
On October 16, sources said that Mr. Dinh Xuan Dieu, Chairman of the People's Committee of Krong Pak district, Dak Lak province, has just issued a document on the implementation of compensation for teachers whose labor contracts have been terminated and the payment of court fees to the state budget.
3 out of 6 teachers won the case after the first instance trial
According to the document, on October 9, the District Civil Judgment Enforcement Office issued a document on the enforcement of the amount that the District People's Committee must jointly compensate the teacher whose labor contract was terminated and pay court fees to the budget.
The District People's Committee seriously criticized the Department of Internal Affairs and the Board of Directors of Nguyen Thi Minh Khai Secondary School and Ea Kly Secondary School for not complying with the advice on compensation for teachers whose labor contracts were terminated and paying court fees as previously directed.
The District People's Committee directed the Department of Home Affairs to preside over and coordinate with relevant departments and units to urgently advise the District People's Committee to thoroughly execute the two judgments of the Dak Lak Provincial People's Court.
Request Nguyen Thi Minh Khai Secondary School and Ea Kly Secondary School to promptly implement and execute the two judgments based on legal regulations and the actual situation of the schools.
As reported by Nguoi Lao Dong Newspaper, at the end of 2021, Ms. Nguyen Thi Binh, a teacher at Ea Kly Secondary School (Krong Pak District), sued the school for illegally terminating her labor contract. The person with related rights and obligations is the People's Committee of Krong Pak District.
The People's Court declared that Ea Kly Secondary School and the People's Committee of Krong Pak District are jointly responsible for compensating Ms. Binh more than 175 million VND and paying insurance from November 2018 to November 2021.
Similarly, in early 2022, five teachers of Nguyen Thi Minh Khai Secondary School sued the school for having their labor contracts terminated illegally. The court ordered Nguyen Thi Minh Khai Secondary School and the People's Committee of Krong Pak District to jointly compensate the teachers a total of more than 1.2 billion VND.
On October 9, 2023, the People's Committee of Krong Pak district submitted a document to the People's Committee of Dak Lak province and the Department of Finance requesting an additional amount of more than 2.1 billion VND to pay for 6 teachers according to the verdicts and court fees.
However, the Dak Lak Provincial Department of Finance said that the teachers whose labor contracts were terminated and won the lawsuit were not eligible for compensation under the Law on State Compensation Liability. Therefore, the province could not allocate funds to pay, and the district People's Committee had to arrange funds to execute the judgment.
At the end of 2023, a leader of the People's Committee of Krong Pak district said that the district would determine when the violations occurred and which individuals were responsible for them, and then they could ask that individual to be responsible for compensation. However, up to now, the 6 teachers who won the lawsuit are still waiting for compensation.
