In Official Letter No. 03/CV-BCĐ regarding the orientation of some tasks for the reorganization of administrative units and the organization of two-level local governments, the Steering Committee for the reorganization of administrative units at all levels and the development of a model for the organization of two-level local governments clearly stated that it is necessary to organize public consultations on the Plan for the reorganization of provincial and commune-level administrative units.

To meet the deadline for the reorganization of provincial and commune-level administrative units in 2025 as required by the Politburo and the Secretariat in Conclusion No. 137-KL/TW, and to allow localities flexibility and initiative in implementation in accordance with practical realities, Resolution No. 74/NQ-CP stipulates: "The People's Committee of the province shall organize the collection of opinions from voters representing households in the administrative units at the provincial level to be merged (for the policy of reorganizing provincial-level administrative units), and in commune-level administrative units directly affected (for the policy of reorganizing commune-level administrative units)."

The provincial People's Committee shall decide on the form, order, procedures, and timeframe for soliciting opinions in accordance with the local practical conditions, ensuring the timely submission of the administrative unit reorganization plan dossier as required by Conclusion No. 137-KL/TW and Resolution No. 74/NQ-CP.

To ensure uniformity in content, order, and procedures for soliciting public opinion at the local level, the Steering Committee for the reorganization of administrative units at all levels and the construction of a two-tiered local government organizational model proposes that the Provincial People's Committee may choose to distribute opinion survey forms (according to the mẫu in Official Letter No. 03/CV-BCĐ) or choose other appropriate methods such as collecting opinions via electronic information websites, holding meetings of household representatives at the commune, village, or neighborhood level for voting, etc.

The process of soliciting public opinion on the plan to reorganize commune-level administrative units can be carried out simultaneously with the process of soliciting opinions on the plan to reorganize provincial-level administrative units.

Regarding the lead agency for developing the plan for reorganizing provincial-level administrative units and the agency responsible for organizing public consultations, the Steering Committee proposes the following: It is suggested that the Standing Committee of the Provincial Party Committee or City Party Committee (where the political-administrative center is selected) should take the lead and coordinate with the Standing Committee of the Provincial Party Committee at the same level to develop the plan for reorganizing provincial-level administrative units (the Plan).

Regarding the organization of public consultations in a particular locality, the Standing Committee of the provincial or city Party Committee in that area will direct the organization of these consultations.

Clause 3, Article 10 of the Law on Organization of Local Government in 2025 stipulates: "Proposals for the establishment, dissolution, merger, division of administrative units, adjustment of boundaries, and renaming of administrative units must be subject to public consultation in the commune-level administrative units directly affected."

The provincial People's Committee is responsible for organizing public consultations on the establishment, dissolution, merger, division of administrative units, adjustment of boundaries, and renaming of administrative units through appropriate forms as prescribed by the Government .
