Kinhtedothi - The Hanoi Department of Natural Resources and Environment has issued a document announcing the implementation of procedures for extending land use rights according to the 2024 Land Law to meet practical requirements.
According to the Hanoi Department of Natural Resources and Environment, the 2024 Land Law and Government Decree No. 102/2024/ND-CP dated July 30, 2024, detailing the implementation of some articles of the Land Law (effective from August 1, 2024), specifically Clause 18 of Article 3, Clause 3 of Article 172 of the 2024 Land Law, and Clause 5 of Article 112 of Government Decree No. 102/2024/ND-CP, stipulate the procedures for extending land use rights as follows:

Land use extension is the act of a competent State agency allowing the continued use of land after its expiration date for the current purpose as stipulated in the Land Law. Land use extension is granted in the final year of the land use term, except in cases specified in Point a, Clause 1, Article 172 of the Land Law. Land users wishing to extend their land use must submit an application for extension at least six months before the expiration date. If the application is not submitted within the deadline, the land use extension will not be granted, except in cases of force majeure. If the land use extension is denied, the competent State agency will reclaim the land in accordance with the provisions of the Land Law.
In cases where the land use period has expired but the competent State agency has not yet reclaimed the land by the effective date of Decree No. 102/2024/ND-CP, the land user may carry out the procedure to extend the land use period within 6 months from the effective date of this Decree. After this period (February 1, 2025), if the land user does not carry out the extension procedure, the State will reclaim the land, except in cases of force majeure.
To ensure timely implementation of the 2024 Land Law and Government Decree No. 102/2024/ND-CP dated July 30, 2024, and to guarantee the rights and obligations of land users, the Hanoi Department of Natural Resources and Environment requests that organizations, households, and individuals whose land use rights have expired or whose remaining land use rights are less than one year, promptly contact the Department (for organizations) or the District/Town/City Department of Natural Resources and Environment where the land is located (for households and individuals) to have their land use rights extended according to regulations.
Furthermore, the Hanoi Department of Natural Resources and Environment also requested the Department of Planning and Investment to review investment projects using land whose operating periods have expired or are about to expire, in order to carry out procedures for adjusting or extending the operating period of investment projects in accordance with investment law. The Department of Planning and Investment should be notified of cases that do not meet the conditions for adjusting or extending the operating period of investment projects so that coordination can be carried out in accordance with the Land Law 2024 and its implementing decrees.
