Good news for social housing buyers.

Following the expansion of eligibility criteria under Decree No. 54/2026, many people are concerned about whether owning land but not a house qualifies them to purchase social housing. Regarding this issue, the Department of Housing and Real Estate Market Management ( Ministry of Construction ) has provided a specific response.

A resident of Hung Yen province stated that both he and his wife are low-income workers and need to purchase social housing. Currently, they are jointly listed on the land title deed for a plot of land, but the certificate does not contain information about a house built on the land. He questioned whether his case meets the new regulation's condition of "not owning a house."

In response to the above, the Department of Housing and Real Estate Market Management stated that, in order to purchase or rent-to-own social housing, people must belong to the group eligible for support policies and fully meet the housing and income conditions as stipulated by law.

According to point a, clause 1, Article 78 of the 2023 Housing Law, buyers of social housing must not own any house in the province or city where the social housing project is located. Furthermore, they must not have previously purchased, leased, or received any form of housing support in that locality. If they already own a house, the average living space per person must be lower than the minimum level stipulated.

Furthermore, Article 29 of Decree 100/2024/ND-CP clearly stipulates two cases in which housing eligibility will be considered.

Firstly, individuals who do not own their own home are defined as those whose names or housing information are not found in the Certificate of Land Use Rights and Ownership of Assets Attached to Land in the locality where the social housing project is located. Within 7 days of receiving the application, the competent authority will verify the housing status.

Secondly, even if a person already owns a house, if the average usable floor area is less than 15 m2 per person, they may still be eligible. This area is calculated based on the number of people registered as permanent residents in the house, including the applicant, spouse, parents, and children (if any). The commune People's Committee will verify the information within 7 days of receiving the application.

Based on the above regulations, the Department of Housing and Real Estate Market Management affirms that: In cases where citizens (and their spouses) do not have their names or information about housing listed in the Certificate of Land Use Rights and Ownership of Assets Attached to Land in the province or centrally-governed city where the social housing project is located, they meet the housing requirements to purchase social housing.

Accelerating social housing development: Over 36,500 units started construction in 4 months.

In 2026, the target for social housing development nationwide is 158,723 units. According to the Ministry of Construction, in the first four months of 2026, construction began on an additional 40 projects with a scale of 36,590 units, reaching approximately 23% of the target.

To date, the whole country is investing in the construction of 786 projects with a scale of 725,146 units, reaching 72.5% of the target assigned to the entire "Investment in the construction of at least 1 million social housing units for low-income earners and industrial park workers in the period 2021 - 2030" project.

Regarding the field of housing management and the real estate market, the Ministry of Construction informed that, in implementing the Plan to draft the amended Law on Housing and the amended Law on Real Estate Business, the Ministry of Construction has submitted the drafts to the Ministry of Justice for appraisal and is currently finalizing the policy documents for these two laws to submit to the Government.

Simultaneously, the Ministry of Construction also submitted and the Government issued Decree No. 136/2026/ND-CP amending Decree No. 100/2024/ND-CP on the development and management of social housing, which includes many adjustments aimed at removing difficulties, simplifying procedures, and expanding income requirements for beneficiaries of social housing.

The Ministry of Construction is currently finalizing the draft National Technical Standard on safety for apartment buildings (existing and newly constructed) with electric tram stations/poles, based on feedback from the Standing Committee of the Party Committee of the Ministry of Construction, before submitting it to the Minister for promulgation.

Continuing to promote the implementation of the Project "Investing in the construction of at least 1 million social housing units for low-income earners and industrial zone workers in the period 2021-2030", the Ministry of Construction has established a working group to inspect, supervise, and work directly with 10 localities to resolve difficulties and accelerate the implementation of the project.

At the same time, the Ministry of Construction also finalized the Regulations and organizational and operational mechanisms of the Central Housing Fund (which has been submitted to the Standing Committee of the Ministry's Party Committee for comments); completed the database on housing and the real estate market, including piloting the assignment of identification codes for housing and real estate...
