Implementing Resolution No. 278/NQ-CP dated September 13, 2025 of the Government

Implementing the Resolution of the thematic meeting on law-making in September 2025 (first session) of the Government (Resolution No. 278/NQ-CP dated September 13, 2025); to ensure progress and quality in the work of drafting legal documents, the Ministry of Culture, Sports and Tourism issued Document No. 4809/BVHTTDL-PC requesting Heads of agencies and units to study Resolution No. 278/NQ-CP to advise on the drafting and completion of the legal system in the fields assigned for management advice.

Accordingly, Heads of agencies and units under the Ministry continue to research and advise on the full institutionalization of the Party's guidelines and policies and the State's policies; focus on resolutely implementing the work of building and perfecting institutions - one of the three strategic breakthroughs and one of the important pillars, creating a strong driving force to bring the country firmly into the new era; review current legal regulations to propose the completion of an open legal system, with a mindset of innovation and development creation, with plans to thoroughly handle difficulties and problems from the recommendations and feedback received, especially from people, businesses and localities.

Law-making work needs to thoroughly grasp the spirit of "6 enhancements", including: (1) Strengthening the Party's leadership, concretizing the Party's policies and guidelines; (2) Strengthening the collection of opinions and absorbing opinions from relevant subjects, impacted subjects, experts and scientists; (3) Strengthening the reduction of at least 30% of the number of administrative procedures, reducing time, costs, inconvenience for people and businesses, implementation time and compliance costs; (4) Strengthening decentralization and delegation of power along with resource allocation, improving enforcement capacity and inspection and supervision; (5) Strengthening coordination with relevant agencies and functional units of the National Assembly, the National Assembly Standing Committee, and agencies in the political system; (6) Strengthening adherence to practice, respecting practice, starting from practice, taking practice as a measure, removing difficulties and obstacles from practice.

For the dossiers and draft laws to be amended and supplemented, it is necessary to clarify the "6 stars": (1) Why are they omitted; (2) Why are they completed; (3) Why are they supplemented; (4) Why are procedures cut; (5) Why are they decentralized and delegated; (6) Issues with different opinions and other issues that need to be reported to the Government for direction.

For new draft laws, it is necessary to ensure "6 musts": (1) Must thoroughly understand the Party's policies and guidelines; (2) Must resolve practical problems and difficulties; (3) Must listen to and absorb valid opinions from the people, experts, and scientists ; (4) Must assess policy impacts; (5) Must be strict in procedures, processes, and regulations; (6) Must ensure resources for implementation and practice.

Strengthen policy communication, create broad consensus. Improve the quality of human resources for law-making with appropriate incentive mechanisms and policies, paying attention to timely rewards and incentives, prioritizing resources for developing technology infrastructure, big data, artificial intelligence (AI), etc. in building and organizing law enforcement. "What is mature, clear, proven to be correct in practice, agreed by the majority, and under the authority of the National Assembly, then legislate; what is still fluctuating and not under the authority of the National Assembly, then develop Government decrees to regulate".

The Director of the Press Department urgently completes the draft Law dossier in accordance with the direction in Resolution No. 278/NQ-CP and the provisions of the Law on Promulgation of Legal Documents; closely coordinates with relevant agencies and units under the Committee on Culture and Society in the process of examining and completing the draft Law to submit to the National Assembly for consideration, comments and approval at the 10th Session of the 15th National Assembly (October 2025).

The Director of the Copyright Office proactively coordinates and advises the Ministry's leaders in giving comments on the Law amending and supplementing a number of articles of the Intellectual Property Law on contents related to copyright.

The Director of the Legal Department monitors and urges agencies and units to carry out the work of building and perfecting institutions and laws; periodically reports to the Ministry's leaders on the situation and results of building laws and perfecting institutions of the Ministry every month./.
