Protecting people who dare to think and dare to do is impossible?

Debating with delegate Tran Quoc Tuan (Tra Vinh), delegate Tran Huu Hau (Tay Ninh) agreed that there is a group of cadres and civil servants who are afraid of making mistakes and pushing responsibility. But delegate Tran Huu Hau offered more in-depth analysis of the causes leading to the state of officials and civil servants being afraid of making mistakes and pushing such responsibilities.

Delegate Tran Huu Hau (Tay Ninh) said that, if in the performance of official duties, in order to do well their duties and responsibilities, there are clear and appropriate regulations and legal corridors, then it is certain that the majority of civil servants and public employees will only need to make efforts, be creative, find a way to do it more effectively, there is nothing to be afraid of.

However, in reality today, in many things, if the decision is made to meet the requirements of reality, to bring efficiency to the people and the country, it must violate the current regulations and laws of the State. “Therefore, those who see that they do not comply with the regulations or the law, even though they do not know fear for the common good, are probably "deaf and not afraid of guns" or lack a sense of discipline," said delegate Tran Huu Hau. 

Since then, delegate Tran Huu Hau commented that protecting people who dare to think and dare to do seems impossible, because in many such cases it is to protect jobs that are against the regulations and against the law. Then there is the need to protect the person who protects the enterprising person. Going up the ladder, they may have to go to the National Assembly, because the obstacle that makes them not dare to think, dare to do lies in the inappropriateness and contradiction of current laws.

Delegate Tran Quoc Tuan (Tra Vinh) said that there are currently two groups of officials who are afraid of responsibility. The first is that cadres are degraded in political ideology, cadres avoid, fear responsibility, push, fear wrong, cadres do not want to do it because there is no benefit. Second, officials are afraid of breaking the law, so they don't dare to do it.

Delegate Tran Quoc Tuan suggested that the National Assembly and the Government should focus on researching, reviewing, amending and supplementing fully the provisions of the law, especially the sub-law documents, ensuring the rigor, consistency and ease of application. Promote decentralization and decentralization more. If this work is done well, it will reduce pressure and burden on superior agencies, and at the same time increase responsibility for localities and lower agencies. To do so, it is necessary to determine what is the responsibility of the locality, boldly delegate authority to the locality to do, and the locality will be responsible before the law. At the same time, continue to strengthen inspection and supervision to guide, remind and urge the effective performance of official duties.

"For that reason, it is common for subordinates to consult their superiors, wait for instructions from their superiors, and even be given clear tasks, but the deeper they go into implementation, the more problems they find themselves in, so they move back to their superiors to ask for their opinions before doing it," said delegate Tran Huu Hau.

According to delegate Tran Huu Hau, looking back at the construction and promulgation of the decree on encouraging and protecting those who dare to think and dare to do, it seems to be almost the same. In this regard, the Politburo has concluded 14, the 6th Plenum of the Central Committee has Resolution 28, the National Assembly has assigned the tasks in Resolution 75 in 2022, the Government and the Prime Minister at the Regular Meeting in February 2, and Official Letter 2023 has assigned the Ministry of Home Affairs to urgently implement the draft decree to report to the Government in June. 

“The direction and direction is very clear. But after 3 times of revising the draft and collecting opinions, the Ministry of Home Affairs finds that it is entangled with many provisions of the law, so it is advising and reporting to the National Assembly Standing Committee for a pilot resolution to encourage and protect cadres who dare to think and do. Only then did the Government issue a decree," said delegate Tran Huu Hau.

The agencies are doing the right thing, but the hot work of the people and the country is frozen

From the above analysis, delegate Tran Huu Hau said that it is necessary to do so that cadres, civil servants and public employees at all levels do not have to dare to think, dare to do, do not need to be encouraged and protected by their superiors. Cadres, civil servants and public employees at all levels need to focus their efforts and intelligence to be active and creative in performing their jobs most effectively for the people and for the country within the framework of the Party's regulations and the State's laws. To do so, when detecting unsuitable laws and regulations, focus on correcting immediately with the process so that it is strict, but simple and concise.

Delegate Tran Huu Hau expressed in response to the Prime Minister's question to the delegate's own question: "The law is up to us. In practice, we are entangled, but the entanglement is caused by us. Then we have to fix it." 

However, delegate Tran Huu Hau emphasized, it is too difficult to correct the irrationalities set by ourselves. There are many issues that are brought to the table, each official, each concerned agency has their own arguments and seems to be correct. Unfortunately, in many cases, when most of the individuals and units involved are right, trying to do the best, right according to their functions and powers, there are hot things of the people and the frozen country.

“We cannot accept such illogical, anti-regular phenomena. The right goes with the right to bring openness, to help the country develop, to meet the people's expectations. What is right and what is right cannot lead to stagnation, to the poverty of the country," said delegate Tran Huu Hau.

We have come up with the right solution, which is to issue a resolution of the National Assembly to promptly remove difficulties and obstacles in practice, or a law to amend many laws. Emphasizing that, delegate Tran Huu Hau asked the National Assembly to consider for a more appropriate way, order and procedures to promptly remove arising problems. Thus, cadres, civil servants and public employees less have to dare to think, dare to do, focus their energy and intelligence to be dynamic and creative to better perform their responsibilities and tasks in the openness of the provisions of the law.
