Construction on rice paddy land must not exceed 0.1% of the area and a maximum of 500m2.

The Provincial People's Committee has just issued a Decision regulating the area, location, and purpose of use of construction works directly serving agricultural production on rice-growing land in the province. This is a concrete step in implementing Government Decree No. 112/2024/ND-CP dated September 11, 2024, on detailed regulations concerning rice-growing land.

Construction on rice paddy land must not exceed 0.1% of the area and a maximum of 500m2.

According to the newly issued decision, which will take effect from April 20, 2025, the area of ​​rice paddy land permitted for construction must be concentrated and have a minimum area of ​​50 hectares.

Regarding construction area, the total land area for construction is regulated with a maximum ratio of no more than 0.1% of the total area of ​​rice paddy land permitted for construction, but in all cases it must not exceed 500m2.

Notably, the decision allows construction to be carried out in one or more different locations within the rice paddy area, but the total area must not exceed the regulations. These constructions must also comply with the National Technical Standard on Construction Planning QCVN 01:2021/BXD and other relevant legal regulations.

Regarding land use purposes, the constructed structures must serve one of the purposes stipulated in Clause 6, Article 3 of Decree No. 112/2024/ND-CP on rice cultivation land. These purposes must all be directly related to agricultural production activities.

The decision also imposes strict requirements on protecting rice-growing land. Specifically, plots or areas of rice-growing land permitted for construction must have a valid land use right certificate or meet the conditions for obtaining such a certificate as stipulated by law.

Another important point is that when dismantling or relocating structures, the necessary conditions for the land to return to its original purpose of rice cultivation must not be lost. Compensation and support for the dismantling of structures will be carried out according to the law in effect at the time of implementation.

To ensure effective implementation, the People's Committee of Thanh Hoa province has assigned the Department of Agriculture and Environment to take the lead, in coordination with the Department of Construction and other relevant units, in organizing, monitoring, and inspecting the implementation of the Decision. The People's Committees of districts, towns, and cities are required to strengthen management and supervision of land use for construction projects and will be held accountable to the Provincial People's Committee if any violations of the law occur within their jurisdiction.

The People's Committees of communes, wards, and towns are responsible for disseminating the Decision to organizations, individuals, and land users of rice cultivation within their jurisdiction, and for managing, inspecting, supervising, and maintaining records of land use for the construction of facilities directly serving agricultural production.
