
Addressing difficulties and obstacles in delegating the authority to approve certain aspects of oil and gas operations.
This Resolution stipulates the handling of difficulties and obstacles in delegating the authority to approve certain aspects of oil and gas activities under several articles of the Oil and Gas Law No. 12/2022/QH15 dated November 14, 2022 (Oil and Gas Law 2022) and Government Decree No. 45/2023/ND-CP dated July 1, 2023 detailing certain articles of the Oil and Gas Law. The subjects of application are Vietnamese and foreign agencies, organizations, and individuals involved in oil and gas activities in Vietnam.
Assigning PVN to perform the tasks and powers of the Ministry of Industry and Trade in certain aspects of oil and gas operations.
The resolution assigns the Vietnam National Energy and Industry Corporation (PVN) the task and authority of the Ministry of Industry and Trade as stipulated in the 2022 Petroleum Law and Decree No. 45/2023/ND-CP, ensuring that it does not affect national defense and security with regard to the following contents:
1. Approval of the general plan for oil and gas field development , except for onshore oil and gas field development projects, oil and gas field development projects with a synchronized chain of onshore and offshore oil and gas facilities and equipment, and approval of adjustments to the general plan for oil and gas field development in cases of changes in the development plan, except for gas projects and projects with changes in land use requirements for approved oil and gas discoveries.
The appraisal and approval process by PVN is carried out according to the procedures issued by PVN as stipulated in Clause 7, Article 48 of Decree No. 45/2023/ND-CP. PVN is responsible for the use of its capital in the event that PVN participates in an oil and gas contract as a contractor.
2. Approve adjustments to the early exploitation plan for oil and gas fields in the following cases:
a) The adjustments result in a reduction in the total investment, regardless of the changes to the work items and the cost of each item;
b) Adjustments resulting in an increase of less than 10% in total investment, except in the case of constructing additional platforms.
The appraisal and approval process by PVN is carried out according to the procedures issued by PVN as stipulated in Clause 9, Article 49 of Decree No. 45/2023/ND-CP. PVN is responsible for the use of its capital in the event that PVN participates in an oil and gas contract as a contractor.
3. Approve adjustments to the oil and gas field development plan for the following cases:
a) The adjustments result in a reduction in the total investment, regardless of the changes to the work items and the cost of each item;
b) Adjustments resulting in a total investment increase of less than 10%, excluding the construction of additional platforms.
The appraisal and approval process by PVN is carried out according to the procedures issued by PVN as stipulated in Clause 8, Article 50 of Decree No. 45/2023/ND-CP. PVN is responsible for the use of its capital in the event that PVN participates in an oil and gas contract as a contractor.
4. Approve adjustments to the decommissioning plan for oil and gas facilities in cases where the adjustments result in a decrease or increase of less than 20% in the estimated costs of the most recently approved decommissioning plan by the Ministry of Industry and Trade, regardless of the nature of the changes.
The appraisal and approval process by PVN is carried out according to the procedures issued by PVN as stipulated in Clause 6, Article 51 of Decree No. 45/2023/ND-CP.
5. Approval of oil and gas resource and reserve reports (first time) for oil and gas fields with total oil in place less than 30 million m³, total gas in place less than 30 billion m³, excluding oil and gas resource and reserve reports directly prepared by PVN for oil and gas contracts where PVN is the Operator or Investor.
The assessment and approval process by PVN is carried out according to procedures issued by PVN.
PVN is responsible for reporting to the Ministry of Industry and Trade the results of the approval of the aforementioned delegated authority contents.
This Resolution shall be effective from the date of signing until February 28, 2027. In the event that the Petroleum Law is amended or supplemented and comes into effect before February 28, 2027, it shall apply until the effective date of the amended or supplemented Petroleum Law.
