Expanding the investigation into the case of "Abuse of position and power while performing official duties" that occurred at the Tan Thinh residential area project (Doi 61 commune, Trang Bom district) invested by LDG Investment Joint Stock Company, Dong Nai Provincial Police have prosecuted and temporarily detained Nguyen Khanh Hung, Chairman of the Board of Directors of LDG Investment Joint Stock Company.

DONG NAI PROVIDES INFORMATION
Specifically, on November 29, the Investigation Police Department of Dong Nai province issued a decision to prosecute and an order to temporarily detain Nguyen Khanh Hung for the crime of "deceiving customers" as stipulated in Article 198 of the 2015 Penal Code (amended and supplemented in 2017). These decisions were approved by the People's Procuracy of Dong Nai province.
On November 30th, the Investigation Police Department of Dong Nai province, in coordination with the People's Procuracy of the same level, executed a search warrant at the residence and workplace of suspect Nguyen Khanh Hung.
Previously, on May 29th, the Investigation Police Department of Dong Nai Province issued a decision to initiate a criminal case for the crime of "Abusing position and power while performing official duties" as stipulated in Article 356 of the 2015 Penal Code (amended and supplemented in 2017) to investigate and clarify violations in the implementation process of the Tan Thinh residential area project.

Following the investigation, on June 16th, the Dong Nai Provincial Police Investigation Agency initiated criminal proceedings and executed arrest warrants against Mr. Phan Duy Nghia (59 years old), former Head of the Urban Management Department of Trang Bom District, and Mr. Nguyen Hai Trieu (45 years old), Deputy Head of the Urban Management Department of Trang Bom District.
In addition, the Investigation Police Department of Dong Nai Province also initiated criminal proceedings (releasing her on bail) against Ms. Nguyen Lan Hanh, a specialist in the Department of Natural Resources and Environment of Trang Bom District.
The residential area is now almost deserted, with only a few houses remaining.
On September 26th, the Investigation Police Department of Dong Nai province, in coordination with the People's Procuracy of the same level, executed an indictment and arrested two more officials: Mr. Luong Quang Huy (44 years old), former Deputy Head of the Urban Management Department of Trang Bom District, now Chairman of the People's Committee of Giang Dien Commune (Trang Bom District), and Mr. Nguyen Van Nhat Huy (46 years old, specialist in the Urban Management Department of Trang Bom District), on charges of abusing their positions and authority while performing their official duties.
The irregularities at the Tan Thinh residential project were placed under monitoring by the Central Steering Committee on Anti-Corruption and Negative Phenomena (at the end of 2022). The case is currently being investigated by the Dong Nai Provincial Police.
In March 2023, the Chairman of the People's Committee of Dong Nai province signed the inspection report on this project. According to the inspection report, the Tan Thinh residential area project, invested by LDG Investment Joint Stock Company, has a total area of 18.22 hectares. From 2018 to 2020, despite not having completed the procedures for land allocation, land lease, permission to change land use purpose, and not having been granted construction permits, the investor illegally built 680 houses along with transportation infrastructure, parks, etc. LDG Investment Joint Stock Company also signed house purchase contracts with 60 customers with a total value of over 132 billion VND.
According to the Dong Nai Provincial Inspectorate, the project has a total of 12.7 hectares of rice paddy land, but the relevant agencies only recorded and determined 6.34 hectares, leading to a failure to report in a timely manner to the competent authority to seek the Prime Minister's opinion on allowing the conversion of rice paddy land (according to the 2013 Land Law, the conversion of rice paddy land of 10 hectares or more falls under the authority of the Prime Minister).
The inspection report also concluded that in May 2018, the People's Committee of Doi 61 Commune (Trang Bom District) inspected and discovered violations but did not issue an administrative violation report. In June 2018, the Department of Planning and Investment of Dong Nai Province, in coordination with the Department of Natural Resources and Environment of Trang Bom District, inspected the project and prepared a report on the current status, but the content was altered. Specifically, the phrase "the investor has leveled the ground" was changed to "the investor has cleared the ground," leading to an inaccurate recording of the current status.
Based on the aforementioned violations, the Dong Nai Provincial Inspectorate identified more than 20 individuals involved, including leaders of the Trang Bom District People's Committee; leaders and specialists of the Trang Bom District Department of Natural Resources and Environment and the District Land Development Center; four chairmen and vice-chairmen of the Doi 61 Commune People's Committee and commune land officials; the Director and Chief Inspector of the Dong Nai Department of Construction during the period when LDG Investment Joint Stock Company implemented the project; and two individuals from the Dong Nai Department of Planning and Investment who participated in the inspection, preparation, and alteration of the minutes, which were inaccurate. In addition, 13 organizations were also involved in the violations. The Chairman of the Dong Nai Provincial People's Committee requested that the organizations and individuals involved be held accountable, their responsibilities clarified, and appropriate disciplinary action taken according to their authority.
