Director of Dai An Company, Tran Thi Minh Kiem, arrested for selling "phantom" land plots in Ho Chi Minh City.

On November 6th, the Ho Chi Minh City Police Investigation Agency announced that it had initiated a criminal case, indicted and detained Tran Thi Minh Kiem (born in 1979, residing in Dong Thanh commune, Hoc Mon district - Director of Dai An Surveying and Mapping Trading and Service Company Limited) for investigation into the crime of fraud and appropriation of property.

Previously, the investigating agency received a criminal complaint regarding the fraudulent appropriation of property through real estate transactions by Tran Thi Minh Kiem.

According to the complaint, the transactions involved plot number 195, map sheet number 8 (area 949m²) and plot number 413, map sheet number 9 (area 1,567m²) in Dong Thanh commune, Hoc Mon district, registered under the name of Mr. TVC as the owner.

Before his death in 2005, Mr. TVC subdivided and sold the entire area of ​​these two plots of land to several other people, but he still retained the Land Use Right Certificate and entrusted its management to his wife, Ms. NTV, and his daughter, Ms. THT.

Kiem provided false information, telling Ms. NTV that plot 195 had 4m² remaining, adjacent to plot 196 (registered under the name of Mr. TVT - Kiem's ​​ex-husband), and requested Ms. NTV to authorize him so that when plot 196 was sold, the 4m² of plot 195 would be included.

On October 17, 2017, Ms. NTV and Ms. THT went to a notary office on Ba Trieu Street, Hoc Mon town, Hoc Mon district to sign a power of attorney contract. Due to trust and not carefully reviewing the content, Ms. NTV and Ms. THT signed a power of attorney authorizing Kiem to manage the entire remaining area of ​​plot 195 (247.2m²) and plot 413 (52m²). In reality, the area specified in this power of attorney contract did not exist.

Having obtained the land use rights certificate and power of attorney, Kiem sought out Ms. BTTH (residing in Ward 22, Binh Thanh District) to mortgage these documents to borrow 1 billion VND. When the repayment deadline arrived and he was unable to pay, Kiem took Ms. BTTH to plot 196, claiming it was plot 195, and simultaneously hired someone to draw a map showing the current status of plot 195 superimposed on the location of plot 196.

Kiem also stamped the seal of Dai An Surveying and Mapping Trading and Service Co., Ltd. on the drawing, confirming that this was indeed plot 195. On March 20, 2019, Kiem and Ms. BTTH signed a contract to transfer 247.2m² of plot 195 for 1.5 billion VND at a notary office.

When Ms. BTTH went through the procedures to transfer ownership at the Hoc Mon District Land Registration Office branch, she discovered that the land plot she had purchased did not exist and filed a complaint against Kiem with the Ho Chi Minh City Police Investigation Agency.

The Ho Chi Minh City Police Investigation Agency has announced the fraudulent scheme of Tran Thi Minh Kiem and advised people to be cautious in real estate transactions.
