The Decree devotes Chapter II to regulating data processing activities, including: criteria for determining important data; criteria for determining core data; data storage activities; data access and retrieval; supporting data owners in connecting and sharing data with state agencies; providing data to state agencies; data confirmation and authentication; data disclosure; data encryption and decryption; cross-border data transfer and processing.
Chapter III regulates data administration and management; identification and management of risks arising in data processing; data protection; management of data protection during processing; human resource management and training and development of data protection personnel; data security monitoring, early warning and emergency management.
National Data Center Infrastructure
Regarding the infrastructure of the National Data Center, the Decree clearly states: The National Data Center builds and develops cloud computing infrastructure and deploys it into functional areas to serve the needs of state agencies, ensuring the development of integrated, synchronous subsystems, data exploitation, and high requirements for information security.
The National Data Center establishes high-performance computing infrastructure and data analysis systems to serve management with predictive analysis models to exploit the National Comprehensive Database.
At the same time, provide technical conditions to support research and development in the field of applied mathematics; support the work of building policy mechanisms, planning, national development strategies, developing products and services on data to serve socio -economic development.
The National Data Center establishes a national data portal as a focal point for state agencies to publish information about the types of data they are managing; publish open data, provide open data to increase transparency in government operations and promote innovation, economic and social development.
The National Data Center provides the following types of services:
a) Infrastructure services for stations, server locations, providing infrastructure space, electrical systems, air conditioning and other related equipment to deploy database information systems, allowing database owners, agencies and organizations in need to proactively use and control their systems, in the form of using shared space or in separate areas, in compliance with regulations on management and operation of the National Data Center;
b) Services providing servers, network equipment, network information security, network security, confidentiality or storage with diverse configurations, corresponding placement space at National Data Centers, suitable for the needs of database owners, agencies and organizations in need;
c) Services for deploying and operating technical infrastructure serving national databases and database information systems, databases and other information systems.
Also according to the Decree, state agencies and socio-political organizations shall determine the types of services provided by the National Data Center, ensuring compliance with the current status, business requirements, regulations on investment in information technology projects using state budget capital, and send a written request to the National Data Center to provide services.
The content of the proposal document must clearly define the need to use the services of the National Data Center; the scale of the system expected to be located at the National Data Center; the need for human resources to support the management and operation of the infrastructure and information systems.
The National Data Center helps the Ministry of Public Security carry out state management of data.
The National Data Center is responsible for guiding agencies, organizations and individuals in applying technical standards and regulations on data within the scope of synchronization to the National Data Center.
Implement measures to monitor and evaluate the quality of shared and synchronized data to the National Data Center.
Coordinate data of the National Comprehensive Database.
Implement data protection measures applied from the beginning and throughout the data processing process as prescribed in Clause 6, Article 16 of this Decree.
Sign agreements and memorandums of understanding with international agencies and organizations to promote international cooperation in data management, protection, scientific research, cross-border data transfer, training, capacity building and qualifications in data-related contents to promote innovation and technology transfer activities to serve socio-economic development.
The National Data Center helps the Ministry of Public Security carry out state management of data.
The Ministry of Public Security shall preside over and coordinate with relevant agencies to deploy the construction of a National Data Center that meets regulations, standards, and technical regulations for data centers.
Support regime for officers and soldiers working at the National Data Center
The Decree also stipulates the assurance of resources for the construction and development of the National Data Center. Accordingly, the National Data Center develops plans and training programs, international cooperation, and improves the quality of human resources of the National Data Center.
Officers and soldiers working at the National Data Center are entitled to a support level of VND 500,000/working day from the revenue from data exploitation and usage fees in the National General Database after submitting to the state budget.
Organizations and public service units under the National Data Center may apply this support regime to decide on regimes for people working in data expertise.
The Minister of Public Security promulgates a list of job positions at the National Data Center; promulgates a mechanism to attract, employ, and reward high-quality human resources working for the National Data Center.
