Abolish demotion and salary reduction for civil servants

In the new decree, the Government has eliminated two forms of disciplinary action: demotion for leading civil servants and salary reduction for civil servants not holding positions.

Decree 172/2025 issued by the Government on June 30 stipulates four forms of discipline for civil servants including reprimand, warning, dismissal (applicable to civil servants in leadership and management positions) and forced resignation, eliminating the two forms of demotion and salary reduction.

According to regulations from 2023, civil servants who do not hold leadership or management positions can be disciplined in four forms: reprimand, warning, salary reduction, and forced resignation. For civil servants in leadership and management positions, in addition to the above forms, there are also demotion and dismissal. Those who are demoted will not be planned, appointed, trained, or promoted for 24 months; those whose salary is reduced will also be similarly restricted for 12 months.

The Decree also classifies the level of violation as a basis for disciplinary action. A violation is considered to have less serious consequences if the level of harm is not large, only affects the internal scope, and affects the reputation of the agency. A serious violation is when the act causes great harm, spreads outside the unit, causes bad public opinion, and reduces the reputation of the organization. A violation causing very serious consequences is when the nature and level of violation are especially serious, affecting the whole society, causing resentment among cadres, civil servants and people, and damaging the reputation of the agency or organization.

Depending on the nature and severity, civil servants can be handled at four levels. Reprimand is applied to first-time violations with less serious consequences. If they have been reprimanded and continue to violate, or if the first violation is serious, civil servants will be warned. For leading civil servants, if they allow serious violations to occur in their units without taking measures to prevent them, they will also be warned, even if they themselves only committed minor violations.

In case of re-offending after being warned, or first-time violation with very serious consequences but showing an open-minded attitude and proactively overcoming the consequences, the offender will be dismissed. Forced dismissal will be applied if the offender does not correct himself or continues to re-offend after being dismissed or warned; or first-time violation with very serious consequences and showing no attitude of acceptance and overcoming the consequences.

In addition, civil servants who use fake or illegal diplomas, certificates, or confirmations to be recruited; drug addicts... are also subject to forced dismissal according to the provisions of this decree.

The Decree takes effect from July 1, 2025.
