According to the National Assembly Delegation of Dong Nai province, Decree 100/2019 (amended in Decree 123/2021) of the Government, regulates penalties for vehicle drivers who violate regulations on alcohol concentration in addition to fines. also stripped of license.
However, the regulation to strip violators' driving license is not appropriate, causing damage to people, because this is a necessary document for driving vehicles and at the same time it is also a means of serving people. serving people's living needs.
"Authorities need to study and amend the regulations in the direction of increasing the severity of penalties to serve as a deterrent and it would be more appropriate not to revoke the driver's license of violators," Dong Nai province voters suggested.
Responding to this issue, the Ministry of Transport said that revocation of the right to use a driver's license (also known as revocation of driver's license) is an additional form of punishment for individuals driving vehicles who violate serious traffic violations.
This includes the act of driving a vehicle with alcohol in the blood or breath, a violation that is assessed to have a high risk of affecting the safety of the vehicle driver as well as the safety of people and vehicles involved. participating in other traffic and violating regulations and requirements for driving license users.
Currently, additional sanctions are specifically stipulated in Decree 100/2019 and Decree 123/2021 amending and supplementing Decree 100/2019.
Based on each specific case of violation, the vehicle driver may have the right to use the driving license revoked (when driving cars, motorbikes, motorbikes, specialized motorbikes and similar vehicles). or certificate of training in legal knowledge about road traffic (when driving specialized motorbikes) from 1 - 24 months.
The highest level of penalty is deprivation of the right to use the driving license for 22 - 24 months as prescribed in Point h, Clause 11, Article 5, Point g, Clause 10, Article 6, Point e, Clause 10, Article 7, Decree 100/2019.
This fine is applied to drivers of cars, motorbikes, and motorbikes (including electric motorbikes) who commit one of the violations related to alcohol concentration such as driving a vehicle participating in traffic. when the alcohol concentration in blood or breath exceeds 80 milligrams/100 milliliters of blood or exceeds 0,4 milligrams/liter of breath; Failure to comply with requests to test alcohol levels of people on duty; or related to the use of drugs. In addition to having the right to use the driving license revoked, car drivers who violate the above violations will be fined from 30 - 40 million VND; Motorbike and motorbike drivers who violate the above violations will also be fined from 6 - 8 million VND.
