Ministry of Transport submits to the Government the Draft Law on Railways (amended)

The Ministry of Transport has just submitted to the Government the Draft Law on Railways (amended), focusing on breakthrough innovations, creating a legal corridor for railway development.


In the Government's report on February 19, the Ministry of Transport said that the project was built with the aim of continuing to institutionalize the Party and State's policies and guidelines on railway development.

Overcoming institutional shortcomings and inadequacies, creating new momentum for the development of the railway industry, promoting the competitiveness of railway transport, and serving people's travel needs.

The draft Law was reviewed, redesigned and reduced by 2 Chapters and 12 Articles. Accordingly, the draft Railway Law (amended) consists of 8 Chapters and 73 Articles. The basic content focuses on 5 important and breakthrough innovations to create a legal corridor for railway development.

Accordingly, regarding investment in developing railway infrastructure, the draft Law stipulates maximum mobilization of local resources and all economic sectors to participate in investing in building railway infrastructure. In particular, there are provisions on encouraging all organizations and individuals to participate in investing in developing railway infrastructure through many forms of contracts (BT, BOT, BTO, BLT, BTL...).

Regulations on shortening and simplifying investment procedures and processes; regulations on exploiting land funds in the vicinity of railway stations (TOD) to maximize resources for developing railway infrastructure.

Regarding the management and exploitation of railway infrastructure, the regulations stipulate that the organization assigned to manage the railway infrastructure assets invested by the State shall organize the management and maintenance of the railway infrastructure. Amend and supplement the regulations on the lease and transfer of the right to exploit the railway infrastructure assets invested by the State for a limited period to attract and diversify the types of enterprises participating in the management and investment in railway development such as "Public leadership - private administration", "Public investment - private management", "Private investment - public use"...

Regarding railway transport activities, regulations assign responsibility to the railway management and operation organization to regulate and maintain a safety management system to improve railway transport activities.

Regarding the connection of transport modes, the draft Law adds a requirement that when investing in railway construction, it is necessary to ensure synchronous and effective connections between railway lines and between railways and other transport modes; stipulates that international airports, large seaports, and traffic hubs must have a plan to connect with railways, promote the advantages of each mode and multimodal transport.

Regarding the development of railway industry and human resources, supplement regulations on a number of railway industrial products in the List of high technologies prioritized for investment and development according to the provisions of the law on high technology.

Investment projects in the construction of railways and railway industrial works with bidding packages organized for international bidding must have conditions binding foreign contractors to transfer technology and train human resources for Vietnamese partners to master management, operation, exploitation, maintenance and gradually master technology.

Regulating the list of railway industrial services and goods assigned or ordered. Researching, applying, receiving technology transfer and some specific policies for organizations and individuals performing scientific and technological tasks serving the development of the railway industry.

At the same time, the draft Law also cuts 4 administrative procedures, amends the implementing subjects of 10 administrative procedures to create more convenience. Strongly decentralizes power to local authorities in investment, management and operation of railway infrastructure...
