Faced with difficulties and backlogs in the process of issuing land use right certificates, Vu Thu district recently implemented a new approach: deploying officials to the grassroots level to assist people in carrying out the procedures for obtaining land use right certificates for the first time. Trung An commune has been piloting this initiative.

The yearning for a land ownership certificate.

For many years, Mr. Tran Xuan Hung's family in Lang Trung village has lived on land inherited from his father, but they lacked legal documentation. In 2005, he auctioned off the land use rights for two additional plots in the same village. In reality, for decades, Mr. Hung's family has been the owner of these three plots, but legally, Mr. Hung has not been recognized as the owner due to the absence of a land use right certificate. Consequently, his legitimate rights and interests related to these three plots of land have been affected.

In 2005, Mr. Hoang Trong Diep's family, from Vu Phuc commune ( Thai Binh city), participated in an auction for land use rights for 6 plots of land in Lang Trung village. For nearly 20 years, Mr. Diep has repeatedly gone back and forth, trying to obtain land use right certificates for his plots, but without success. Without these certificates, Mr. Diep cannot mortgage his property or borrow money from banks, and his family's production and business activities face many difficulties. Therefore, Mr. Diep has always longed to obtain "pink certificates," or land use right certificates, for his plots of land.

Trung An commune has 4 villages with over 2,000 households. According to statistics, only about 10% of the commune's households have land use right certificates. More than 90% of the remaining households do not have them and are eagerly awaiting the State to issue land use right certificates for their family's residential land.

Explaining this, Mr. Phung Van Tao from An Loc village shared: "Currently, land and houses are among the biggest assets of the people. When people have a land use right certificate, they feel more confident because the land is managed by the State, and their legitimate rights and interests are protected. In rural areas, farmers do not easily mobilize finances when needed; if they have a land use right certificate, they will have a much easier time borrowing from banks. Having a land use right certificate also helps people transfer, gift, and inherit land to their children and grandchildren in accordance with the law, avoiding potential conflicts later on. Despite its many benefits, for many years, the people of Trung An have faced many difficulties and inconveniences when carrying out the procedures for registering and obtaining land use right certificates. Therefore, holding a land use right certificate in hand has always been a desire of the local people."

A breakthrough in approach

With numerous difficulties and obstacles in the initial issuance of land use right certificates, such as incomplete cadastral data; frequent land changes; inadequacies in administrative procedures for issuing land use right certificates; and the low level of expertise and responsibility of some district and commune officials… If the old methods are maintained, Vu Thu district will only issue 300-500 new land use right certificates to people each year. At this rate, it will take decades to issue tens of thousands of land use right certificates to households throughout the district. Thus, the hope and aspiration of the people of Vu Thu to receive land use right certificates will remain a distant dream.

To solve the difficult problem of issuing initial land use right certificates, Vu Thu is currently the only district in the province that has boldly and pioneered the pilot implementation of issuing initial land use right certificates at the grassroots level. The district established a Steering Committee for issuing land use right certificates, mobilizing leaders, heads of departments, sectors, and localities to overcome difficulties, resolve outstanding issues, and accelerate the process of issuing initial land use right certificates to households. In particular, with the enthusiasm and responsibility of the Party committee and the commune and village authorities, Trung An was selected as a pilot area, and the issuance of initial land use right certificates at the grassroots level began in late July 2023.

Mr. Nguyen Tong Thin, Vice Chairman of the People's Committee of Vu Thu District and Deputy Head of the Standing Committee of the District's Land Use Right Certificate Issuance Steering Committee, said: Instead of people going to the district, district officials went directly to the villages and communes to implement the issuance of land use right certificates for the people of Trung An. The entire political system from the district, commune, and village levels joined forces with a high sense of responsibility, genuine unity, and consensus, becoming a powerful force that resolved many bottlenecks and obstacles in the issuance of land use right certificates that had remained unresolved for decades.

Before implementation, the district, in coordination with the communes, urgently reviewed and compiled all land data for each household in the commune. The process of issuing land use right certificates was publicized and disseminated to every village. When people register for the first-time issuance of land use right certificates, district and commune officials will check, verify, and classify each file. In addition to the workforce, the district has equipped the local areas with computers and printers to support the task. Therefore, people find it very easy and convenient to complete the procedures for obtaining land use right certificates. All stages and steps of implementation were carefully planned by the district and commune steering committees, implemented quickly, and utilized to the maximum extent, ensuring that people do not have to wait or anticipate for long periods.

“To ensure the implementation progress, many members of the District Steering Committee and the Commune Steering Committee had to work intensely, regardless of working late into the night, without Saturdays or Sundays, and without counting working hours. Personally, during the two peak months of implementing the land use right certificate issuance work in Trung An, I volunteered to work, eat, and live at the facility, ready to be present 24/7 to serve the people and carry out the task of issuing land use right certificates,” shared Mr. Pham Duy Long, Deputy Head of the Labor, War Invalids and Social Affairs Department of Vu Thu District, and Secretary of the District Steering Committee for issuing land use right certificates.

The biggest challenge faced by the district and communes in Trung An in issuing land use right certificates is the lack of land data, while land use by the people is constantly changing. Therefore, one of the innovative and legally compliant approaches is for the district and communes to establish appraisal councils, with representatives from the Party committee, local government, and residents in each residential area participating in reviewing land records for each household, ensuring objectivity, openness, and transparency. As a result, although the issuance of land use right certificates is a sensitive and complex issue, Trung An has gained the consensus and enthusiastic support of the people.

The people benefit.

After nearly 20 years of waiting, Mr. Nguyen Van Cuong from Lang Trung village emotionally shared: "This is the plot of land that my family won in the bidding process from the commune in 2005 , but only now have we received the land use right certificate. I am very happy; from now on, I can rest assured that I can bequeath the land to my son, so that he can build a house and have a stable place to live."

Starting in late July 2023, Trung An commune has so far collected 1,200 applications for land use right certificates in all four villages. The district and commune have completed the review and classification of 100% of the applications; and coordinated with the consulting unit to complete the surveying for nearly 200 land plots in Lang Trung village. The commune's Steering Committee has reviewed nearly 100 applications that meet the criteria for land use right certificate issuance and submitted them to the District People's Committee for appraisal. On October 1st, Vu Thu district issued the first 40 land use right certificates to residents of Trung An commune as part of the pilot program. These are all households that participated in the auction of land plots in the commune since 2005, and whose applications had been lost and pending for nearly 20 years. This has created a sense of excitement and great motivation for the households to continue supporting and participating. The remaining files are being made public and the procedures are being supplemented according to regulations, continuing to issue land use right certificates to the people.

“The process of issuing land use right certificates at the grassroots level is extremely difficult and arduous, with many unforeseen situations and even historical issues. However, witnessing the fulfillment of people's hopes and aspirations, and seeing the radiant smiles on people's faces when receiving their land use right certificates, we are extremely pleased and will continue to strive to gradually issue all land use right certificates according to the people's registration needs,” said Mr. Nguyen Van Trinh, Chairman of the People's Committee of Trung An commune and Head of the Steering Committee for issuing land use right certificates in Trung An commune.

Identifying the implementation of the initial issuance of land use right certificates at the grassroots level as a difficult task is something that the district and commune Party committees and authorities have taken upon themselves. However, for the legitimate rights and aspirations of the people, we are ready to face difficulties and challenges. The initial success in Trung An serves as motivation and experience for the district to continue implementing the issuance of land use right certificates in Tan Phong and throughout the district, contributing to resolving obstacles and meeting the legitimate aspirations of the people.

We mobilized officials, Party members, the elderly, influential people in the residential area, and the people to actively cooperate and participate with the district and commune in the process of verifying the origin and history of use of each plot of land. Because the people were given the opportunity to "know, discuss, participate, and monitor," they were very enthusiastic and actively cooperated and contributed to the work of issuing land use right certificates with the Party committee and the government.

Previously, we had to go to the district and commune many times but were unable to obtain land use right certificates. Now, all procedures for issuing land use right certificates are done at the local level, which is very convenient and fast. We are very pleased and grateful to the Party committee and the government at all levels, and we hope that other eligible plots of land in the commune will soon be issued land use right certificates.
