On August 30th, the National Assembly's specialized delegates discussed the draft Law on Land (amended). During the discussion, delegate Pham Thi Thanh Mai ( Hanoi delegation) argued that the purpose of land use is a crucial basis for calculating financial revenues from land, and therefore needs to be specifically regulated in the law. This would serve as a foundation for government decrees on land revenue collection policies, land pricing policies, handling land violations, and comprehensive and consistent land statistics.

Article 9 of the draft law stipulates land classification but lacks provisions for classifying multi-purpose land, which will create difficulties in management. The representative suggested that the drafting committee add the concepts of "land use purpose" and "primary land use purpose" to the glossary.

Regarding compensation and resettlement support when land is reclaimed, and the regulations on the principles for handling cases where the state reclaims land and the remaining area of ​​the reclaimed plots is smaller than the minimum area for subdivision as stipulated by the Provincial People's Committee, Representative Mai argued that land reclamation is necessary, but adjustments should be made to suit practical realities to avoid the emergence of "extremely thin, extremely distorted" plots of land.

Also related to land reclamation, delegate Nguyen Anh Tri (Hanoi delegation) commented on the issue of land reclamation for some stalled projects.

Representative Tri argued that for all projects, regardless of size, if approved by the government, the government must be involved in the land clearance and acquisition process.

The delegate stated that for projects where 70% or more of the land has been cleared, after two years, compulsory land acquisition will be carried out, and compensation will be at the rate stipulated by the State. If a number of households remain, the government needs to be involved in the compensation and clearance process. Therefore, delegate Nguyen Anh Tri hopes that these sub-legal documents will include specific regulations.

Regarding Article 9 on land classification, delegate Nguyen Anh Tri highly appreciated the Drafting Committee's attention to the group of land (cemeteries, funeral homes, crematoriums, and ash storage facilities) that plays an important role in social life.

However, to achieve this, the delegates suggested that sub-legal documents are needed to guide the effective, dignified, hygienic, civilized, and humane use of this land.

Meanwhile, delegate Le Thanh Hoan (from Thanh Hoa province) stated that land acquisition and compensation for resettlement are important issues that greatly affect the rights of the people. Every year, land-related complaints continue to occur.

Therefore, the delegates from Thanh Hoa province believe that the draft amended Land Law needs to include sustainable policies for cases of compulsory land acquisition.

Meanwhile, delegate Nguyen Thien Nhan (from Ho Chi Minh City) argued that when discussing land use, it must stem from national interests, local interests, business interests, and the interests of the people. Therefore, these three interests need to be clarified further. Along with that, the attributes of the land need to be determined.

According to Representative Nhân, land attributes include location and area. Some land locations are suitable for transportation, while others are near rivers or the sea… each location has different advantages. "When considering national and local interests, it is necessary to determine what can be done with the land location to maximize benefits for the country and the locality," Mr. Nhân stated.

Representative Nguyen Thien Nhan argued that land with a specific location and area should be used in a way that is most beneficial to the country and the locality, as this constitutes the national interest.

For example, if that land location is best suited for a road, then the land must be reclaimed for transportation purposes. Land should be reclaimed for projects that are most meaningful to the nation or locality, in the best interests of the country or locality .
