Ending the negative consequences of the dual-price system.

The 2024 Land Law's official abolition of the land price framework and its replacement with an annually updated land price list based on market principles is expected to completely end the negative consequences of the decades-long dual-price mechanism.

In Dak Lak, with the new land price list effective from January 1, 2026, the locality is determined to bring land values ​​back to their true value, creating leverage to increase market transparency, remove bottlenecks in land clearance, and unlock resources for socio -economic development.

For a long time, the land price framework issued by the State has been considered the "backbone" of land management. However, in reality, this framework price is always lower than market transaction prices, especially in urban and suburban areas where infrastructure is developing rapidly and the demand for land use is increasing.

According to the 2024 Land Law, land price tables will be developed by the Provincial People's Committee, submitted to the Provincial People's Council for approval and promulgation, and applied from January 1st of each year. Land prices are determined based on a transparent system of data: actual transaction data, results of land use right auctions, planning information, infrastructure, and land use purposes. The fundamental change is that land prices are no longer based on an average framework but are determined in detail for each location and each plot of land. At the same time, annual updates help the land price table reflect market fluctuations in a timely manner, avoiding the situation where "state prices lag behind market prices" as before.

The development of a new land price list, gradually aligning with actual market transaction prices, is expected to eliminate the dual-price mechanism (between the state-set price and the actual market transaction price), which has long been a cause of reduced budget revenue, disputes in compensation and land clearance, and a lack of transparency in the land market.

"Overall, eliminating the 'two-price' mechanism and bringing land prices back to their true value is not only a requirement of modern management, but also the foundation for land to truly become an important and sustainable resource for the socio-economic development of Dak Lak province in the new era," - Director of the Department of Agriculture and Environment .

In Dak Lak, the Provincial People's Council issued Resolution No. 19/2025/NQ-HĐND on December 24, 2025, promulgating a new land price list, effective from January 1, 2026. This is considered an important preparatory step for the locality to enter a phase of land management based on market principles, in line with new development requirements. Gradually bringing land prices closer to actual transaction prices means restoring land policy to its proper role: a crucial tool for regulating resources, instead of becoming a "bottleneck" to development.

According to the Department of Agriculture and Environment, when land prices are established based on market principles and updated regularly, the financial obligations regarding land for individuals and businesses will be determined more accurately. At the same time, the State will have an additional tool for more effective and transparent land management in the context of an increasingly complex real estate market.

Mr. Nguyen Minh Huan, Director of the Department of Agriculture and Environment, stated: The issuance of the new land price list, effective from the beginning of 2026, is considered an important preparatory step to make the real estate market operate more transparently, especially in compensation and land clearance for projects. Compensation prices that closely reflect real value will contribute to reducing complaints, creating consensus among the people, thereby accelerating the implementation of projects, increasing budget revenue for reinvestment in transportation infrastructure, schools, hospitals, social welfare projects, and providing resources for compensation for key public investment projects in the province, thus improving the overall quality of life for the community and people in the province. This is a positive impact, beneficial to the whole society.

However, the land prices in this Land Price List are very close to actual transaction prices, which could increase project input costs. This requires localities to synchronize policies on planning, taxes, fees, and market control to ensure a balance of interests between the State, the people, and businesses. In addition, building a transparent land price database, improving valuation capacity, and strengthening enforcement monitoring are prerequisites for the new land price list to be effective.
