Is tutoring and extra classes within schools considered a business?

Throughout the 2019 Education Law, there is no wording that defines teaching or educational activities as business. Article 99 of the Education Law uses the phrase "educational and training services." Article 5 of the draft circular regulating supplementary teaching and learning states: "Organizations or individuals conducting supplementary teaching and learning outside of school…", is this appropriate? If supplementary teaching and learning outside of school is considered a business activity, then is supplementary teaching and learning within schools also considered a business activity?

Will the draft circular regulating tutoring and supplementary classes trigger a "boom" in tutoring and supplementary classes?

Students have to attend extra classes on top of extra classes?

The draft circular does not prohibit teachers from giving extra lessons to students they are directly teaching in school. Therefore, if a teacher gives extra lessons to students they directly teach, are they allowed to give extra lessons to these students when they also give extra lessons outside of school? If the draft circular doesn't clarify this, students might find themselves in a "double bind." In reality, students are receiving extra lessons at school and at home from the same "recipient."

Should voluntary, free-of-charge tutoring be eliminated?

According to the draft circular, extra tutoring is defined as teaching the content of a subject's curriculum, an educational activity that goes beyond the prescribed time allocation and involves charging additional fees. So, what do we call voluntary extra tutoring outside the curriculum without charging fees? Tutoring weak students and nurturing gifted students—these are responsibilities and unique educational activities that demonstrate the dedication and commitment of teachers to their students—where will they stand in the school system? Will this, or will it, transform into extra tutoring to… collect tuition fees?

Circular 32/2020/TT-BGDĐT, which promulgates the Regulations for Junior High Schools, High Schools, and Multi-level General Education Schools, states in Clause 1, Article 19: "Educational activities are carried out according to the school's educational plan, organized inside and outside class hours, inside and outside the school grounds, in order to implement the curriculum of subjects and educational activities of the general education program…". Does this content incur fees?

From this, is it possible that an educational activity that students should be benefiting from is now being included in… supplementary classes? Concerns arise over the regulation allowing principals to provide extra tutoring.

According to the draft circular regulating extracurricular tutoring, school principals are allowed to teach extra classes. As a former principal, I am worried about this. In the context of educational reform, as the head of a school, principals are already overwhelmed with school duties, devoting all their energy and time to managing and teaching the mandatory two lessons per week in high schools, and now they are being allowed to teach extra classes.

This is unrealistic and absurd. Principals already have high salaries and "paychecks," so how can they possibly be seen as tutoring?

The State is gradually reforming salaries, with teachers' salaries proposed to be the highest in the administrative and public service salary scale. Recently, the Politburo requested the implementation of the policy of highest salaries for teachers. This attention demands that the education sector and every teacher dedicate themselves wholeheartedly to their students.

As an educator, after reading and studying the draft circular regulating supplementary teaching and learning, and based on my own experience, I haven't yet fully grasped that precious sentiment.
