Proposal for a 3-level People's Procuracy model

(Chinhphu.vn) - On the morning of April 25, continuing the 44th Session, under the direction of Vice Chairman of the National Assembly Nguyen Khac Dinh, the National Assembly Standing Committee gave opinions on the draft Law amending and supplementing a number of articles of the Law on Organization of the People's Procuracy.

Chief Justice of the Supreme People's Procuracy Nguyen Huy Tien presented a report at the meeting.

Presenting the Draft Law on amending and supplementing a number of articles of the Law on Organization of the People's Procuracy, Chief Justice of the Supreme People's Procuracy Nguyen Huy Tien said that the development of the Law aims to institutionalize the Party's policies related to the organization, functions and tasks of the People's Procuracy in Resolution No. 18-NQ/TW, Conclusion No. 126-KL/TW, Conclusion No. 127-KL/TW, Conclusion No. 136-KL/TW of the Politburo , Secretariat and Resolution No. 60-NQ/TW, dated April 12, 2025 of the 11th Conference of the 13th Party Central Committee to arrange and streamline the organization, improve the effectiveness and efficiency in the organization and operation of the People's Procuracy at all levels; accordingly, this amendment only amends the provisions related to the new organization.

Accordingly, the People's Procuracy system is reorganized and rearranged to include the Supreme People's Procuracy, Provincial People's Procuracy, Regional People's Procuracy, and Military Procuracy at all levels. The draft law stipulates that the People's Procuracy apparatus will be changed from a 4-level model (supreme, high-level, provincial, and district levels) to 3 levels (supreme, provincial, and regional levels).

Based on the policies of the Party and State, with the scope and viewpoints on drafting the Law, the Supreme People's Procuracy proposes a draft Law consisting of 3 articles with the following contents: Amending and supplementing a number of articles of the Law on Organization of the People's Procuracy; effective date; transitional provisions.

Presenting the review report, Chairman of the Law and Justice Committee Hoang Thanh Tung said that the Committee agreed with the necessity of promulgating the Law amending and supplementing a number of articles of the Law on Organization of the People's Procuracy for the reasons stated in the Submission.

At the same time, the scope of the amendment is basically approved, which is to focus on amending the regulations related to the arrangement and streamlining of the apparatus of the People's Procuracy to institutionalize the resolutions and conclusions of the Party. The draft Law dossier has all the documents as prescribed in Clause 5, Article 51 of the Law on Promulgation of Legal Documents 2025; it is qualified to be submitted to the National Assembly Standing Committee for consideration and comments.

Regarding the People's Procuracy system, the Committee agrees with the draft Law and recommends that the Supreme People's Procuracy continue to review and propose amendments to relevant provisions in the current Law on Organization of the People's Procuracy to fully and properly implement the Party's requirements on a three-level People's Procuracy system, ending the operations of the High-level People's Procuracy and the District-level People's Procuracy.

Regarding the regulation on supplementing the number of prosecutors of the Supreme People's Procuracy, it is requested that the Supreme People's Procuracy carry out the procedure of requesting opinions from competent authorities in accordance with the Regulations.

Speaking at the meeting, Vice Chairman of the National Assembly Nguyen Khac Dinh requested the Supreme People's Procuracy to closely coordinate with the examining agency to complete the draft Law dossier to be submitted to the National Assembly, in which it is necessary to pay attention to ensuring consistency and unification of organizational laws and judicial procedural laws that are also being submitted to the National Assembly for consideration and approval at the 9th Session.

Regarding some specific contents of the draft Law, the Vice Chairman of the National Assembly noted that the scope of amendments only focuses on amending regulations related to the arrangement and streamlining of the People's Procuracy's apparatus. Regarding the addition of the number of prosecutors of the Supreme People's Procuracy, the Supreme People's Procuracy is requested to report to competent authorities in accordance with regulations.
