Proposed model for a three-tiered People's Procuracy.

(Chinhphu.vn) - On the morning of April 25, continuing the 44th session, under the chairmanship of Deputy Speaker of the National Assembly Nguyen Khac Dinh, the Standing Committee of the National Assembly gave its opinion on the draft Law amending and supplementing a number of articles of the Law on the Organization of the People's Procuracy.

Chief Prosecutor of the Supreme People's Procuracy Nguyen Huy Tien presented the report at the session.

Presenting the draft Law amending and supplementing a number of articles of the Law on the Organization of the People's Procuracy, the Chief Procurator of the Supreme People's Procuracy, Nguyen Huy Tien, stated that the purpose of drafting the Law is to institutionalize the Party's policies related to the organizational structure, functions, and tasks of the People's Procuracy as outlined in Resolution No. 18-NQ/TW, Conclusion No. 126-KL/TW, Conclusion No. 127-KL/TW, Conclusion No. 136-KL/TW of the Politburo and the Secretariat, and Resolution No. 60-NQ/TW, dated April 12, 2025, of the 11th Conference of the Central Committee of the 13th Party Congress, aiming to streamline the organizational structure and improve the effectiveness and efficiency of the organization and operation of the People's Procuracy at all levels; accordingly, this amendment only revises the regulations related to the new organizational structure.

Accordingly, the People's Procuracy system will be reorganized to include the Supreme People's Procuracy, provincial-level People's Procuracies, regional People's Procuracies, and military procuracies at all levels. The draft law stipulates that the People's Procuracy apparatus will be changed from a four-tier model (supreme, senior, provincial, and district levels) to a three-tier model (supreme, provincial, and regional).

Based on the policies of the Party and the State, and within the scope and perspective of drafting the Law, the Supreme People's Procuracy proposes a draft Law consisting of 3 articles with the following contents: Amendments and additions to some articles of the Law on the Organization of the People's Procuracy; effective date; and transitional provisions.

Presenting the verification report, Chairman of the Committee on Law and Justice Hoang Thanh Tung stated that the Committee agrees with the necessity of enacting the Law amending and supplementing a number of articles of the Law on the Organization of the People's Procuracy for the reasons as stated in the Submission.

At the same time, there was basic agreement on the scope of the amendments, which focuses only on revising regulations related to the restructuring and streamlining of the People's Procuracy's apparatus in order to institutionalize the resolutions and conclusions of the Party. The draft Law's dossier has all the necessary documents as stipulated in Clause 5, Article 51 of the Law on Promulgation of Legal Normative Documents 2025; it is eligible to be submitted to the Standing Committee of the National Assembly for consideration and comments.

Regarding the People's Procuracy system, the Committee agrees with the draft Law and requests the Supreme People's Procuracy to continue reviewing and proposing amendments to relevant provisions in the current Law on the Organization of the People's Procuracy in order to fully and correctly implement the Party's requirements for a three-tiered People's Procuracy system, ending the operation of the High-Level People's Procuracy and the District-Level People's Procuracy.

Regarding the regulation on increasing the number of prosecutors in the Supreme People's Procuracy, the Supreme People's Procuracy is requested to follow the procedure for seeking opinions from competent authorities in accordance with the Regulation.

Speaking at the session, Deputy Speaker of the National Assembly Nguyen Khac Dinh requested the Supreme People's Procuracy to closely coordinate with the reviewing agency to finalize the draft Law for submission to the National Assembly, paying particular attention to ensuring consistency and uniformity with the organizational laws and judicial procedural laws also being considered and passed by the National Assembly at the 9th Session.

Regarding some specific contents of the draft Law, the Vice Chairman of the National Assembly noted that the scope of amendments should focus only on amending regulations related to the restructuring and streamlining of the People's Procuracy. Regarding the increase in the number of prosecutors in the Supreme People's Procuracy, the Vice Chairman requested the Supreme People's Procuracy to report to the competent authority in accordance with regulations.
