How much is the fine for modifying a motorbike exhaust by the traffic police?
Article 55 of the 2008 Road Traffic Law mentions ensuring regulations on technical safety quality and environmental protection of motor vehicles participating in road traffic as follows:
The production, assembly, modification, repair, maintenance and import of motor vehicles for road traffic must comply with regulations on technical safety quality and environmental protection. Other cars must not be converted into passenger cars.
Vehicle owners are not allowed to change the structure, components, or systems of the vehicle that are not in accordance with the manufacturer's design or the modified design approved by the competent authority.
Therefore, motorbike owners are not allowed to arbitrarily change the characteristics of the vehicle.
Clause 5, Article 30 of Decree 100/2019/ND-CP stipulates:
“…5. Fines from VND 800,000 to VND 2,000,000 for individuals, from VND 1,600,000 to VND 4,000,000 for organizations that are owners of motorbikes, scooters and similar vehicles that commit one of the following violations: …c) Arbitrarily changing the frame, engine, shape, size, or characteristics of the vehicle;…” |
Thus, the act of modifying motorbike exhaust can be fined up to 2 million VND for individuals and up to 4 million VND for organizations.
Does modifying a motorbike's exhaust result in the loss of a driver's license?
According to Clause 15, Article 30 of Decree 100/2019/ND-CP (amended by Point r, Clause 17, Article 2 of Decree 123/2021/ND-CP) stipulating additional penalties for individuals and organizations that commit violations of regulations related to road traffic:
In case of modifying motorbike exhaust pipes, the penalty is imposed according to the provisions of Point c, Clause 5, Article 30 of Decree 100/2019/ND-CP, the driving license will not be revoked.
Current "exhaust" standards

Specifically, the exhaust pipe (muffler) includes the exhaust pipe and muffler mounted on motorcycles and motorbikes.
- Exhaust pipe: pipe to conduct exhaust gas into the air.
- Muffler: Device to reduce noise caused by exhaust gas.
Exhaust pipes are divided into two types:
- Type one: exhaust pipe and muffler are installed in a single system.
- Type two: the exhaust pipe and muffler are separated into two visible separate parts.
General technical requirements for exhaust pipes
The exhaust pipe must be in good condition, free of rust, dents or any defects that may affect its function. The surface of the exhaust pipe must be shiny, beautiful, the surface plating must be even, the welds must be technically guaranteed, penetrated evenly and firmly.
For type two exhaust pipes, the weld joints must be cleaned after assembly. The welds or joints must be completely coated or spray painted.
How to deal with motorcycle exhaust?
According to Point c, Clause 3, Article 6 of Decree 100/2019/ND-CP and Clause 4, Article 2 of Decree 123/2021/ND-CP, revving the engine in a quiet residential area every day will be subject to administrative penalties, specifically:
"Article 6. Penalties for drivers of motorbikes, mopeds (including electric motorbikes), motorbike-like vehicles and moped-like vehicles violating road traffic rules ...3. A fine of between VND 400,000 and VND 600,000 shall be imposed on a driver who commits one of the following violations: ...c) Honking and revving the engine continuously in urban areas and densely populated areas, except for priority vehicles on duty as prescribed;..." |
Thus, the act of revving a motorbike's exhaust can be fined up to 600,000 VND.
