(MPI) – In order to consult widely to complete the draft Decree on registration of cooperative groups, cooperatives, and unions of cooperatives and the draft Circular guiding the registration of cooperative groups and cooperatives communes, cooperative unions and information content, updating, exploiting and managing the National Information System on cooperatives, on February 27, 02, the Ministry of Planning and Investment organized a workshop Please comment on the 2024 draft legal documents mentioned above.
Under the authorization of the Ministry's leaders, Mr. Phung Quoc Chi, Director of the Department of Business Registration Management, Ministry of Planning and Investment, Deputy Head of the Drafting Committee chaired the Workshop. Attending the Conference were Ms. Ingrid Christensen, Director of the ILO Office in Vietnam and representatives of ministries and branches who are members of the Drafting Committee and Editorial Team of Decree and Circulars; leaders of the Department of Planning and Investment of some localities; People's Committees of some districts in the Northern and Central regions; cooperatives; domestic and international experts.

Speaking at the opening of the Workshop, Mr. Phung Quoc Chi said that to carry out assigned tasks, the Ministry of Planning and Investment has chaired and coordinated with relevant agencies to urgently research and develop a draft Resolution. Decision on registration of cooperative groups, cooperatives, and unions of cooperatives and draft Circular guiding the registration of cooperative groups, cooperatives, and unions of cooperatives and information content, updating, exploit and manage the National Information System on cooperatives; Organize consultations with relevant ministries, branches, organizations and individuals.
Through the Workshop, the Ministry of Planning and Investment hopes to continue receiving comments from relevant ministries, branches and agencies. On that basis, the Drafting Committee continues to research, supplement and complete the drafts and when these drafts are issued, they will make an important contribution to the development of cooperative groups, cooperatives and unions. cooperatives, especially contributing to the socio-economic development process in the coming time.
The draft Decree on registration of cooperative groups, cooperatives, and unions of cooperatives for comments at the Workshop has a layout of 06 chapters with 66 articles, of which: Chapter I. General regulations (33 articles) ; Chapter II. Documents, order and procedures for registration of cooperatives and unions of cooperatives, registration of branch operations, representative offices, business locations of cooperatives and unions of cooperatives (3 articles) ; Chapter III. Documents, order, and procedures for registering changes, notifying changes in the content of registration of cooperatives and unions of cooperatives, and registering changes in the registration of operations of branches, representative offices, and locations business points (10 articles); Chapter IV. Documents, order and procedures for notification of business suspension, dissolution registration, re-issuance and revocation of Cooperative Registration Certificate (11 articles); Chapter V. Registration of cooperative groups (7 articles); Chapter VI. Implementation provisions (2 articles).
The draft stipulates that the Decree's applicable subjects include: Cooperative groups, cooperatives, and unions of cooperatives; The local cooperative development support fund operates according to the cooperative model; Agencies, organizations, and individuals related to the registration of cooperative groups, cooperatives, cooperative unions, and cooperative development support funds for the purpose of guidance and detailed regulations, Full content on registration of cooperative groups, cooperatives, and unions of cooperatives assigned in the 2023 Law on Cooperatives to quickly bring the provisions of the Law to life; overcome problems and inadequacies in current regulations on registration of cooperative groups, cooperatives, and unions of cooperatives; Complete the legal framework for registration to establish the Local Cooperative Development Support Fund according to regulations in Decree No. 45/2021/ND-CP.
Draft Circular guiding the registration of cooperative groups, cooperatives, and unions of cooperatives and information content, updating, exploitation and management of the National Information System on cooperatives asking for comments At the Workshop, there are 04 chapters with 17 articles and 64 forms used in registration and implementation of reporting regime of cooperative groups, cooperatives, cooperative unions and other appendices, divided into 06 groups. , including: Group 1: Sample document regulations for cooperatives/cooperative unions; Group 2: Sample documents prescribed for cooperative groups; Group 3: Sample documents for business registration agencies to register and implement reporting regimes for cooperatives and cooperative unions; Group 4: Sample documents prescribed for district-level business registration agencies in registering cooperative groups; Group 5: Samples for exploiting and using the cooperative database; Group 6: Other appendices.
The construction and development of the National Information System on cooperatives is to ensure orientation and create favorable conditions for connecting and sharing data of ministries, branches and localities with the national database. participating in collective economics, clearly defining the responsibilities and rights of units; appropriate, consistent, and synchronous with the digital transformation process of ministries, branches, localities and the process of building a digital Government; ensure feasibility and sustainability.

At the Workshop, delegates focused on discussing and giving opinions on the specific contents of the Drafts.
