Guidance on handover and handling of public assets when rearranging and reorganizing administrative units

For infrastructure assets currently managed by the commune level, the new commune-level administrative unit is responsible for receiving and inheriting the management and use.

In case the old commune-level administrative unit is separated to form many new commune-level administrative units, the new commune-level administrative unit will receive and inherit the management and use of infrastructure assets located in the area according to the administrative unit.

In case the property is located in many new commune-level administrative units, the Chairman of the Provincial People's Committee shall decide on the handover, inheritance of management and use to the new provincial agency or commune-level administrative unit.

For irrigation infrastructure and markets, the commune-level administrative unit is responsible for receiving and inheriting management and use if located within the administrative boundary.

In case the property is located in many new commune-level administrative units, the Chairman of the Provincial People's Committee shall decide on the handover, inheritance, management and use to the new provincial agency or commune-level administrative unit.

For other types of infrastructure assets, the District People's Committee is responsible for synthesizing and reporting to the specialized agency managing the sector or field under the Provincial People's Committee to synthesize and report to the Chairman of the Provincial People's Committee to decide on the assignment of responsibility for receiving and inheriting the management and use.

For infrastructure assets currently managed by the provincial level, the new provincial administrative unit is responsible for receiving and inheriting management and use.

For assets that have not been processed, the commune-level administrative unit will continue to manage and process them.

In case of separation into many new commune-level administrative units, the Provincial People's Committee shall specifically determine the administrative unit responsible for receiving, managing and handling assets.

For assets managed by the asset management unit which is an agency, organization or unit under the district level and has not completed the handling by the time the district level administrative unit is removed, the Chairman of the Provincial People's Committee shall assign the specialized agency under the Provincial People's Committee or the (new) commune-level administrative unit to receive and carry out the management and handling of assets according to regulations...
