Which allowances and subsidies are subject to social insurance contributions?

(Chinhphu.vn) - Ms. Do Hien Thanh (Tay Ninh) asks: From July 1, 2025, will meal allowances and other expenses such as fuel, telephone, housing, childcare support, and clothing, which are specified in the labor contract, be subject to social insurance contributions?

Regarding this matter, the Social Insurance Department of Tay Ninh province responded as follows:

Based on the provisions of the Social Insurance Law No. 41/2024/QH15, the salary used as the basis for mandatory social insurance contributions is stipulated as follows:

For employees whose salaries are determined by the employer, the salary used as the basis for mandatory social insurance contributions is the monthly salary, including the salary based on the job or position, salary allowances, and other supplementary payments agreed upon and paid regularly and stably in each pay period.

Based on the provisions of Article 3 of Circular No. 10/2020/TT-BLDTBXH dated November 12, 2020, which details and guides the implementation of some articles of the Labor Code regarding the content of labor contracts, collective bargaining councils, and occupations and jobs that negatively affect reproductive and child-rearing functions:

"c) Other additional terms as agreed upon by both parties as follows:

... c2) Additional payments of unspecified amounts, along with the agreed salary in the labor contract, paid regularly or irregularly in each pay period, linked to the employee's work process and performance.

Regarding other benefits and entitlements such as bonuses as stipulated in Article 104 of the Labor Code, innovation bonuses; meal allowances; allowances for fuel, telephone, travel, housing, childcare, and raising young children; support when an employee's relative dies, when an employee's relative gets married, or on the employee's birthday; allowances for employees facing difficult circumstances due to work accidents or occupational diseases; and other support and allowances, these should be recorded as separate items in the labor contract.

Therefore, she can refer to the above regulations to find out which types of allowances are subject to social insurance contributions.

Regarding allowances for meals, transportation, telephone, housing, childcare, and clothing, if these are listed as separate items in the labor contract, they are not subject to social insurance contributions.
