What are the consequences for failing to comply with a deployment order?

Accordingly, in implementation of the Law on Military Service dated June 19, 2015, Decision No. 102/QD-TTg dated September 20, 2024 of the Prime Minister on the conscription of citizens in 2025, and Guidance No. 4705/HD-BQP dated October 31, 2024 of the Ministry of National Defense on the selection and conscription of citizens in 2025, from February 13 to 15, young people nationwide will be heading to fulfill their military service obligations in 2025.

According to the plan, the 2025 military conscription ceremony in localities will take place over 3 days. Specifically, on February 13th, 52 provinces and cities will hold the ceremony, including: the Hanoi Capital Command; 6 provinces in Military Region 1; 4 provinces in Military Region 2; 9 provinces and cities in Military Region 3; 11 provinces and cities in Military Region 5; 9 provinces and cities in Military Region 7; and 12 provinces and cities in Military Region 9.

On February 14th, six provinces and cities belonging to Military Region 4 held troop handover ceremonies. On February 15th, five provinces belonging to Military Region 2 held troop handover ceremonies.

From February 13th to 15th, young men across the country will be enlisting for military service in 2025.

Citizens enlisting for military service in 2025 should be aware of certain regulations regarding administrative penalties in the fields of national defense and cryptography, specifically how violations of deployment orders will be handled under the law, in order to protect their rights.

Specifically, according to Decree 37/2022/ND-CP dated June 6, 2022 of the Government, which amends and supplements a number of articles of Decree 120/2013/ND-CP dated October 9, 2013 of the Government stipulating administrative sanctions for violations in the fields of national defense and cryptography.

Article 6 of Decree 37/2022/ND-CP clearly states that violations of regulations on health check-ups for military service will be subject to a fine of VND 10 million to VND 12 million for failing to be present at the correct time or place for the health check-up.

A fine of between 12 million and 15 million VND will be imposed for intentionally failing to comply with a summons for a military service health check.

Military service in 2025: What are the consequences for failing to comply with mobilization orders?

Any person who, during a medical examination, commits fraud to falsify their health classification results in order to evade military service; or gives money, property, or other material benefits worth less than 2 million VND to medical officers, staff, or others to falsify the health classification results of the person being examined or undergoing a military service medical examination in order to evade military service, will be fined from 15 million VND to 20 million VND.

Anyone who fails to comply with a summons for a military service health check-up will be fined between 25 million and 35 million VND.

According to Article 7 of Decree 37/2022/ND-CP, violations of regulations on military enlistment will result in a fine of 30 million to 40 million VND for failing to be present at the designated time or location for assembly.

Anyone who commits fraud to evade military conscription after having passed the military service health examination and meeting the eligibility requirements will be fined between 40 million and 50 million VND. A fine of 50 million to 75 million VND will be imposed for failure to comply with the conscription order.

Evading military service can result in imprisonment.

Those who evade military service, in addition to administrative penalties, may also face criminal charges for evading military service under Article 332 of the 2015 Penal Code.

Accordingly, anyone who fails to register for military service, has been penalized for violating this conscription order, or has been convicted of evading military service and whose criminal record has not been expunged, and continues to violate the law, shall be punished with non-custodial correctional measures for up to 2 years; or imprisonment from 3 months to 2 years.

If the crime involves self-inflicted injury or harm to one's health; committing the crime during wartime; or inciting others to commit the crime, the penalty is imprisonment from 1 to 5 years.
