Proposal to maintain the model of Land Registration Office

On October 13, the Ho Chi Minh City Institute of Natural Resources and Environment Economics sent a petition to the Prime Minister and the Ministry of Agriculture and Environment, proposing to maintain the current model of the Land Registration Office and apply real estate tax rates to limit speculation.

According to the Institute, in the context of the 2024 Land Law being reviewed and adjusting some remaining issues, maintaining the Land Registration Office system is necessary to ensure stability in the process of implementing land procedures.

Currently, two-level local authorities are still facing many difficulties because their staff are not familiar with new policies and models, while the work of digitizing land data according to Articles 163-166 of the 2024 Land Law has just begun.

The land database statistics in the past 90 days between the Ministry of Public Security and the Ministry of Agriculture and Environment are still in the final stage, so changing the model right now could cause disruption.

According to the Institute's assessment, the current Land Registration Office system is operating stably, has high security and good data management capacity. The staff of these offices are familiar with the profession, ensuring effective service to the people.

If the proposal of the Ministry of Agriculture and Environment on abolishing the Land Registration Office from October 15, 2025 to assign this task to commune-level authorities is implemented, many obstacles will arise, especially in localities with large population and data volume such as Ho Chi Minh City and Hanoi.

The Institute believes that Ho Chi Minh City is currently focusing on three key tasks: completing administrative data after the merger, cleaning up land data within 90 days, and digitizing information on lot and plot numbers in the national database. When the technological infrastructure is not ready and commune-level personnel have not been trained in depth, immediately transferring land management rights will easily cause congestion, affecting the people. Therefore, the Institute proposes to postpone the transfer of the Land Registration Office to the commune level until the national database is completed and the synchronous digital infrastructure is deployed.

Previously, the Department of Land Management (Ministry of Agriculture and Environment) proposed transferring the functions of land registration office branches to the commune level, to conform to the two-level local government model.

According to the report sent to the Ministry of Agriculture and Environment, this agency said that currently 34 provinces and cities across the country have established 703 land registration offices under the Department of Agriculture and Environment, with a total of 16,683 officials, civil servants and workers. Of which, the force at the branches accounts for nearly 12,600 people, taking on most of the administrative procedures on land for people and businesses.

To ensure the principle of "one level, one contact" in handling land records, the Department of Land Management proposed to continue maintaining the land registration office under the Department of Agriculture and Environment, responsible for building, updating and operating the provincial land database. At the same time, this agency proposed to transfer the functions of branches to the commune level, in accordance with the two-level government model according to two options.
