On October 13th, the Institute of Resource and Environmental Economics of Ho Chi Minh City submitted a proposal to the Prime Minister and the Ministry of Agriculture and Environment, suggesting maintaining the current model of the Land Registration Office and applying a real estate tax rate to curb speculation.

According to the Institute, in the context of the 2024 Land Law being reviewed and adjusted to address some problematic issues, maintaining the system of Land Registration Offices is necessary to ensure stability in the process of implementing land procedures.

Currently, local authorities at both levels are still facing many difficulties because their staff are not yet familiar with the new policies and models, while the digitization of land data according to Articles 163-166 of the 2024 Land Law has only just begun.

The land database compilation process between the Ministry of Public Security and the Ministry of Agriculture and Environment over the past 90 days is still in progress, so changing the model at this time could cause disruption.

A land registration office in Ho Chi Minh City is always crowded with people.

According to the Institute's assessment, the current land registration office system is operating stably, has high security, and fairly good data management capabilities. The staff of these offices are familiar with the job, ensuring effective service to the public.

Implementing the Ministry of Agriculture and Environment's proposal to abolish the Land Registration Office from October 15, 2025, and transfer this task to commune-level authorities would create many obstacles, especially in localities with large populations and data volumes such as Ho Chi Minh City and Hanoi.

The Institute argues that Ho Chi Minh City is currently focusing on three key tasks: completing administrative land data after the merger, cleaning up land data within 90 days, and digitizing information on lot and parcel numbers in the national database. With the technological infrastructure not yet ready and commune-level personnel not yet having received specialized training, immediately transferring land management authority could easily cause bottlenecks and affect citizens. Therefore, the Institute proposes postponing the transfer of land registration offices to the commune level until the national database is completed and the digital infrastructure is fully implemented.

Previously, the Land Management Department (Ministry of Agriculture and Environment) proposed transferring the functions of land registration office branches to the commune level, in order to align with the two-tiered local government model.

According to a report submitted to the Ministry of Agriculture and Environment, the agency stated that 34 provinces and cities nationwide have established 703 land registration offices under the Department of Agriculture and Environment, with a total of 16,683 officials, employees, and workers. Of these, nearly 12,600 are employed at the branch offices, handling the majority of administrative procedures related to land for citizens and businesses.

To ensure the "one-level, one-point" principle in handling land registration documents, the Land Management Department recommends continuing to maintain the land registration office under the Department of Agriculture and Environment, responsible for building, updating, and operating the provincial-level land database. Simultaneously, the department proposes transferring the functions of the branches to the commune level, in line with the two-tier government model, according to two options.
