However, the focus and the problem that needs to be solved and overcome is the need for solutions to clearly define the powers of the Party and the State, clarifying the “boundary between leadership and management”. In the new situation, General Secretary To Lam set out the requirement: Ensuring that the Party's leadership tasks do not overlap with the management tasks; distinguishing and clearly defining the specific tasks of leaders at all levels in different types of Party organizations, avoiding the situation of making excuses, or duplication and formality. The Party operates within the framework of the Constitution and law is a principle stated in the Party Charter and Article 4 of the 2013 Constitution of the Socialist Republic of Vietnam: "Organizations of the Party and members of the Communist Party of Vietnam operate within the framework of the Constitution and law". This principle has brought about great achievements in the operating mechanism of "the Party leads, the State manages, the people are the masters" in our country. Some urgent solutions From reality, especially through prominent cases and incidents related to a number of Party members, including many Party members holding high positions, it can be seen that: A number of cadres, Party members and Party organizations have not clearly understood the principle of "the Party operates within the framework of the Constitution and law" mentioned above. Some officials and Party members take advantage of their positions and powers to commit corruption, negativity, cover up illegal economic activities, let their wives, children, and relatives profit from their positions and powers... In particular, it is necessary to focus on a number of contents: Firstly, continue to strongly implement the groups of tasks and solutions set forth by the 4th Central Conference of the 13th tenure, which is to carry out more synchronously and drastically the work of building and rectifying the Party, building a socialist rule-of-law State and a comprehensive, clean and strong political system. In addition, it is necessary to build a contingent of cadres at all levels, especially at the strategic level and leaders with sufficient qualities, capacity and prestige, equal to the task; resolutely and persistently fight against corruption and negativity, and strictly handle cadres who violate the law. Secondly, strengthen propaganda and education to raise awareness of responsibility for Party committees at all levels and cadres and party members on the principle that the Party operates within the framework of the Constitution and the law; Focus on strictly implementing the Central Party's regulations on what party members are not allowed to do. The country is entering a new era, an era of growth that requires strong innovation. Promote the role of heads of Party committees and authorities. Fourth, focus on streamlining the apparatus and organization of Party agencies. Fifth, innovate and improve the quality of drafting and promulgating Party documents in a synchronous, comprehensive, focused, key, highly predictable manner, closely following reality. At the same time, perfect regulations on promulgating Party documents to ensure scientific , practical, systematic and strict implementation. Review, detect and overcome overlapping and contradictory contents in the Party's issued documents, and abolish documents that are no longer appropriate. Sixth, strengthen and improve the effectiveness and efficiency of the Party's inspection and supervision work. Promote the role and responsibility of the Party's advisory and support agencies in inspecting and supervising activities in assigned fields. Closely and synchronously coordinate the Party's inspection and supervision work with the State's inspection, auditing and investigation work. Innovation in the Party's leadership and governance methods is a regular, continuous, drastic, synchronous and consistent process within the Party. This is an urgent requirement and task at present when the country is facing a new historical moment, a new era, an era of national growth.
