The announcement stated that the development of a Decree on sea encroachment is an urgent task assigned by the National Assembly in Resolution No. 134/2020/QH14 dated November 17, 2020.
The Decree will be the legal framework for encouraging land reclamation, restoration, and sea encroachment in accordance with the provisions of the 2013 Land Law and implementing the goals set out in Resolution No. 39/2021/QH15 dated November 13, 2021 on national land use planning for the 2021-2030 period, with a vision to 2050, and the 5-year national land use plan for 2021-2025; Resolution No. 18-NQ/TW dated June 16, 2022 of the 13th Party Central Committee.
The Deputy Prime Minister requested the Ministry of Natural Resources and Environment, based on the draft Decree that has been commented on by members of the Government; based on Article 9 of the Land Law on encouraging land reclamation, restoration, sea encroachment, putting vacant land, bare hills, and wasteland with water surface into use according to land use planning and plans; the objectives of Resolution No. 18-NQ/TW and the practical requirements of coastal localities to clarify the political, legal, and practical basis for promulgating the Decree.
Decentralize the procedures for handing over sea areas for sea encroachment and land allocation and lease to localities to ensure consistency and simplification of administrative procedures; review transitional regulations according to the opinions of the Minister of Public Security and the Minister of Justice to ensure strictness and not legalize cases of law violations before the effective date of the Decree; complete the dossier and report to the Prime Minister before July 26, 2023.
