Assignment and delegation of responsibilities for the preparation, appraisal, approval, and management of construction planning in Dak Lak province.

The Provincial People's Committee has just issued a Decision on promulgating the Regulations on the assignment and decentralization of the organization of the preparation, appraisal, approval and management of construction planning in Dak Lak province (the Regulations).

According to the above regulations, the list of construction planning plans is implemented for newly prepared construction plans. The Department of Construction organizes the preparation of the list of construction planning plans for construction plans under the approval authority of the Provincial People's Committee, based on the consensus of the District People's Committee and relevant departments and agencies. The People's Committees of districts, towns, and cities approve the list of construction planning plans under the approval authority of the district-level People's Committee based on the proposal of the district-level construction management agency. Detailed construction plans serving construction investment projects are prepared by the investor.

The construction planning scheme is prepared for a medium-term period of 5 years and is reviewed and supplemented annually in accordance with the socio -economic development plan of the province, district, town, and city. The list of construction planning schemes must identify the planning organization, the estimated budget, and the funding sources as prescribed.

Regarding the preparation, appraisal, and approval of tasks and construction planning projects: The Department of Construction organizes the preparation of tasks and projects for inter-district regional planning, urban master plans, general construction plans for functional areas, and detailed construction plans for functional areas, etc.

The District People's Committee is responsible for preparing the tasks and plans for the district's regional planning; general planning; detailed town planning within its administrative boundaries; and detailed construction planning for areas under its management.
The People's Committee of the commune organizes the preparation of tasks and plans for the general construction planning of the commune, and detailed construction planning of rural residential areas within its administrative boundaries, according to the construction planning plan approved by the People's Committee of the district level.

Departments and agencies under the Provincial People's Committee shall organize the preparation of tasks and general planning projects for functional areas and detailed planning projects for functional areas. The investor of a construction investment project shall organize the preparation of tasks and detailed planning projects for the area assigned to the investor for projects requiring detailed construction planning in accordance with the laws on urban planning, construction planning, and housing.

In addition, the Regulations also assign and delegate the management of construction planning in the area, specifically stipulating the agency responsible for introducing construction sites, providing information on construction planning, sending and storing the results of the approval of tasks and construction planning projects; and specifying the responsibilities of each agency and unit in organizing the implementation of the Regulations on the assignment and delegation of authority for the preparation, appraisal, approval, and management of construction planning in the province.
