Assignment and decentralization of organization to establish, appraise, approve and manage construction planning in Dak Lak province

The Provincial People's Committee has just issued a Decision on promulgating the Regulation on assignment and decentralization of organization of establishment, appraisal, approval and management of construction planning in Dak Lak province (Regulation).

According to the above Regulations, the list of construction planning plans is implemented for newly established construction plans. The Department of Construction organizes the establishment of a list of construction planning plans for construction plans under the approval authority of the Provincial People's Committee based on the consensus of the District People's Committee and relevant departments and branches. The People's Committees of districts, towns and cities approve the list of construction planning plans under the approval authority of the District People's Committee based on the proposal of the district-level construction management agency. Detailed construction planning for construction investment projects is organized by the investor.

The construction planning plan is prepared for the medium-term period of 5 years and is reviewed and supplemented annually in accordance with the socio-economic development plan of the province, district, town, and city. The list of construction planning plans must identify the planning organization, estimated budget and funding source according to regulations.

For the establishment, appraisal and approval of construction planning tasks and projects: The Department of Construction organizes the establishment of tasks and projects for inter-district regional planning, urban master planning, functional area construction master planning, functional area construction zoning planning, etc.

The District People's Committee organizes the preparation of tasks and projects for district planning; general planning; detailed planning of towns within the administrative area under its management; detailed planning for construction of areas assigned for management.
The People's Committee of the commune organizes the preparation of tasks and general planning projects for commune construction, detailed planning for construction of rural residential areas within the administrative boundaries under its management according to the construction planning plan approved by the People's Committee of the district level.

Departments, branches and sectors under the Provincial People's Committee organize the preparation of tasks and general planning projects for the construction of functional areas and zoning plans for the construction of functional areas. Investors of construction investment projects organize the preparation of tasks and detailed planning projects for the construction of assigned investment areas for projects requiring detailed planning in accordance with legal regulations on urban planning, construction planning and housing.

In addition, the Regulation also assigns and decentralizes the management of construction planning in the area, specifically stipulating the agency that introduces construction sites, provides information on construction planning, sends and stores the results of approving tasks and construction planning projects; stipulating the responsibilities of each agency and unit in organizing the implementation of the Regulation on assigning and decentralizing the organization of making, appraising, approving and managing construction planning in the province.
