Regulations on functions, tasks, powers and organizational structure of Notary Office No. 2 under the Department of Justice of Ca Mau province

On September 22, 2025, the Provincial People's Committee issued Decision No. 01084/QD-UBND on regulating the functions, tasks, powers and organizational structure of Notary Office No. 2 under the Department of Justice of Ca Mau province.

Accordingly, the functions, tasks, powers, organizational structure and operating principles are specifically stipulated as follows:

*Location and function

Location: Notary Office No. 2 is a public service unit that partially self-insures regular expenses under the Department of Justice of Ca Mau province, has legal status, has headquarters, has a seal, and is allowed to open its own account at the State Treasury and Bank according to the provisions of law.

Function: Notary Office No. 2 has the function of providing notarization and certification services in accordance with the provisions of the law on notarization and certification and other relevant legal provisions; Notary Office No. 2 is under the direct direction and management of the Department of Justice in terms of organization, staffing and operations; at the same time, it complies with the direction, inspection and guidance on expertise and profession of the Ministry of Justice .

*Duties and Powers

Duties: (1) Monitor and ensure that notaries practicing at their organization perform notarization procedures in accordance with the provisions of law, comply with the Code of Ethics for Notary Practice, the Charter of the Vietnam Association of Notaries and implement decisions of competent state agencies; (2) Comply with the provisions of law on labor, tax, finance, and statistics; (3) Implement the working regime according to the working days and hours of state administrative agencies and ensure that notaries and employees of their organization comply with the regulations on working days and hours of the organization; (4) Post the working schedule, notarization procedures, internal regulations for receiving notarization requests, notarization fees, fees, service prices upon request related to notarization and other costs at the headquarters of their organization; (5) Report to the Department of Justice for approval and post the list of translation collaborators of their organization; (6) Purchase professional liability insurance for notaries of their organization according to the provisions of Article 39 of the 2024 Notary Law; compensate for damages according to the provisions of Article 40 of the 2024 Notary Law; (7) Receive, manage and facilitate notary trainees during their internship at their organization; (8) Create favorable conditions for notaries of their organization to practice notary and participate in annual notary training; (9) Comply with requests of competent state agencies regarding reporting, inspection, examination, and provision of information on notarized transactions; certified papers and documents; (10) Establish a notarization request book, notarization book, other types of books, and archive notarization records according to the provisions of law; (11) Provide information to be entered into the notarization database according to the provisions of Article 66 of the 2024 Notarization Law; (12) Keep the notarization content confidential, except in cases where the notarization requester agrees in writing or the law provides otherwise; Use the seal at the headquarters of the notarization practice organization and comply with the provisions of law on seal management and use; (13) Receive notarization records designated by the Department of Justice according to the provisions of Article 68 of the 2024 Notarization Law; (14) Other obligations as prescribed by the 2024 Notarization Law and other relevant legal provisions.

Powers: (1) Sign work contracts and labor contracts with notaries specified in Point a and Point c, Clause 1, Article 37 of the 2024 Notarization Law and other employees working for their organization; (2) Collect notarization fees, service fees, and prices as required related to notarization, and other costs as prescribed by the 2024 Notarization Law and other relevant laws; (3) Provide notarization services outside of working days and hours of state administrative agencies to meet the notarization needs of individuals and organizations; (4) Exploit and use information from the notarization database, the National Population Database, and related databases as prescribed by law to serve notarization activities; (5) Other rights as prescribed by the 2024 Notarization Law and other relevant laws.

*Organizational structure, number of employees

Organizational structure:   The Board of Directors includes: Head of Department and 02 Deputy Heads of Department. 2. No specialized or professional departments are established under Notary Office No. 2. Officials (groups of officials) in charge of each field work under the specialist regime.

Number of employees : Notary Office No. 2 is assigned based on job positions, professional title structure of civil servants associated with functions, tasks, scope of activities and within the total number of employees of the Department of Justice assigned annually by the Provincial People's Committee.

*Working principles

The Head of Notary Office No. 2 is the head of Notary Office No. 2, responsible to the Director of the Department of Justice and before the law for all activities of Notary Office No. 2.

The Deputy Head of Notary Office No. 2 assists the Head of Notary Office No. 2 in charge of one or several areas of work of Notary Office No. 2, and is responsible to the Head of Office and before the law for assigned tasks. When the Head of Office is absent, the Deputy Head of Office is authorized by the Head of Office to manage all activities of the office and must report to the Head of Office on the results of work during the authorized period.

Notaries exercise their rights and obligations as prescribed in the 2024 Notary Law and related documents, and are responsible to the leadership of Notary Office No. 2 and before the law for the assigned and responsible work;

Other officials shall comply with the provisions of the Law on Civil Servants and its implementing guidelines.
