Birth registration
1. The People's Committee at the commune level is responsible for registering births in the following cases:
a) Children born in Vietnam;
b) Children born abroad who have not been registered at birth, reside in Vietnam, and have at least one parent who is a Vietnamese citizen;
c) Vietnamese citizens, Vietnamese people residing abroad, and people of Vietnamese origin whose nationality is not yet determined but who are living in Vietnam, were born in Vietnam but have not yet been registered at birth, and have records and documents issued and certified by competent Vietnamese authorities.
2. The People's Committee at the commune level, at the option of the person requesting birth registration, is responsible for proactively registering the birth of a child when the data from the medical examination and treatment facility is automatically connected and shared with the electronic civil registration and management system and meets the following conditions:
a) Children born at a medical examination and treatment facility;
b) The person requesting birth registration has provided all the required information for birth registration.
3. In cases where a child born in Vietnam is not registered according to the provisions of Clause 2 of this Article, within 60 days from the date of birth, the father or mother is responsible for registering the child's birth; if the father or mother cannot register the child's birth, the paternal grandfather, paternal grandmother, maternal grandfather, maternal grandmother, older brother, older sister, uncle, aunt, or any individual or organization caring for the child is responsible for registering the child's birth.
4. The birth registration information includes:
a) Information of the person being registered: Surname, middle name (if any), given name; gender; date of birth; personal identification number; place of birth; hometown; ethnicity; nationality.
The determination of the surname, middle name (if any), given name, ethnicity, and nationality of the person being registered at birth shall be carried out in accordance with the provisions of Vietnamese civil law and nationality law.
An individual's place of origin is determined by the father's or mother's place of origin, as agreed upon by the parents when registering the birth. If the parents cannot agree, it is determined according to custom.
b) Information on the parents of the person being registered: Surname, middle name (if any), given name; date of birth; personal identification number (if any); ethnicity; nationality; place of residence. If the parents of the person being registered are unknown, the information on the parents shall be left blank.
