Changes to civil registry information

1. Changes to civil registration information are the acts by which competent civil registration authorities record changes in an individual's personal information when there is a legitimate reason and the conditions are met as prescribed by this Law, the provisions of civil law, and other relevant laws.

2. The scope of changes to civil registration information includes:

a) Changing the surname, middle name, and given name of an individual in the birth certificate when there are sufficient grounds and conditions as prescribed by civil law;

b) Changing information about place of origin in the birth registration of an adult at the request of that adult, or in the birth registration of a minor child at the request of the biological father or mother;

c) Changing information about the father, mother, ethnicity, and place of origin in the birth certificate of an individual when being adopted or after the adoption is terminated;

d) Re-determining ethnicity according to the provisions of civil law; re-determining the ethnicity of abandoned children after their biological father and mother have been identified;

d) Correcting registered civil status information due to errors or inaccurate information;

e) Supplementing missing civil registration information on original civil registration documents, in paper civil registration books, and in the civil registration database;

g) Adjusting the civil status information of a registered individual due to changes made to the individual's civil status information by the individual themselves, or their parents, or their spouse;

h) Other cases as prescribed by law.

3. The People's Committee at the commune level shall carry out changes to civil registration information for the following cases:

a) Registering changes to civil status information for Vietnamese citizens who have registered their civil status in Vietnam, and Vietnamese citizens residing abroad who have registered their civil status in Vietnam, provided they possess the original civil status documents or have information in the paper civil status register or the civil status database;

b) Registering changes to civil status information as stipulated in points b, c, d, e, and g of Clause 2 of this Article for foreigners and people of Vietnamese origin whose nationality has not been determined, residing in Vietnam, who have registered their civil status at a competent Vietnamese authority, and who still possess the original civil status documents or have information in the paper civil status register or the civil status database.

Law on Civil Registration No. 03/2026/QH16 will come into effect on March 1, 2027.

Civil registration applications received before the effective date of this Law that have not yet been processed shall continue to be processed in accordance with the provisions of the law on civil registration in effect at the time of receipt.
