Vietnam Social Security (VSS) announced that Decision 863 of the Ministry of Interior has introduced new administrative procedures, abolishing some procedures in the field of social insurance, including specific guidance on procedures for receiving sickness benefits.

Sick leave benefit procedures
Accordingly, employees are responsible for submitting the required documents to their employers. The deadline for submitting these documents is no later than 45 days from the date of returning to work.
Within 7 working days from the date of receiving complete documents from the employee, the employer is responsible for compiling a list of employees on sick leave and submitting it along with the relevant documents to the Social Insurance agency.
Within 7 working days from the date of receiving all required documents from the employer, the Social Insurance agency is responsible for processing the application. If the application is not processed, a written response must be provided stating the reasons.
The procedure can be done in person, online, or by mail.
The file includes the discharge papers, medical record summary, certificate of sick leave for social insurance benefits, documents proving inpatient or outpatient treatment, and a list of sick leave compiled by the employer.
For medical examinations and treatment abroad, the documents must include a notarized Vietnamese translation, legalized by the consular office, unless otherwise stipulated by an international treaty. The maximum processing time is 7 working days.
The beneficiaries are Vietnamese workers, foreign workers working in Vietnam, and employers. The result is a list of those eligible for sick leave benefits, with no fees charged.
Regulations on sickness benefits for parents when their children are sick.
Workers participating in social insurance are entitled to benefits for treatment of illnesses or accidents outside the scope of work; accidents on the way to and from work along a reasonable route; treatment of relapses due to work accidents; occupational diseases; organ and tissue donation or transplantation; or care for sick children under 7 years old.

The maximum leave for caring for a sick child (for each child) for employees with children under 3 years old is 20 days/year; for children from 3 years old to under 7 years old, the maximum leave is 15 days/year.
If both parents participate in mandatory social insurance, each parent can take leave, but not exceeding the maximum time allowed for each child. In the case of two or more children under 7 years old who are both sick, the benefit period is calculated based on the actual number of days of leave taken to care for the children.
However, employees are not entitled to benefits if they self-injure themselves, use illegal drugs, are undergoing initial treatment for work-related accidents or occupational diseases, or if the treatment coincides with other periods of leave such as maternity leave or paid leave.
