Review and complete regulations on land price determination methods

Perfecting institutions and policies, improving the efficiency of land management and use.

In the Announcement, Deputy Prime Minister Tran Hong Ha concluded: Land valuation is a very important issue in state management of land; difficulties in determining land prices have affected the mobilization of resources from land in recent times. The main cause of the shortcomings identified in the process of summarizing the implementation of the Land Law and Decree No. 44/2014/ND-CP on land valuation methods is that the content and conditions for applying land valuation methods are not suitable; a database on market land prices has not been established, information and input data are not reliable enough, leading to cases where different methods are applied to a plot of land with different results.

Perfecting the technical regulations of each land valuation method

The amendment of Decree No. 44/2014/ND-CP on land price determination methods must be based on correct methodology, scientific basis, experience of countries around the world and current practical conditions of Vietnam. The Ministry of Natural Resources and Environment closely coordinates with the Ministry of Finance , Associations, Vietnam Federation of Commerce and Industry, experts, to review and complete regulations, including:

- Complete technical regulations of each land valuation method; subjects, conditions, and criteria for application to ensure ease of implementation, avoiding arbitrariness in method selection; research with regulations on cases where verification methods need to be applied.

- Regulations on procedures, in the direction of promoting decentralization, delegation of power, cutting down on intermediaries, simplifying administrative procedures, along with enhancing the responsibility of each level, each sector (land valuation consultancy organizations, valuation councils, etc.) and inspection and supervision by superiors in accordance with the principles and requirements in Resolution No. 18-NQ/TW on continuing to innovate and perfect institutions and policies, improving the effectiveness and efficiency of land management and use, creating momentum to turn our country into a developed country with high income.

- Supplement regulations on information collection, data, information sources (auction price data, transaction data from tax authorities, etc.), responsibility for providing information, and access to information of land valuation consultancy organizations to ensure honesty, objectivity, transparency, and legal basis for applying appropriate valuation methods, minimizing dependence on subjective will.

- Complete transitional regulations to ensure compliance with the provisions of the Law on Promulgation of Legal Documents, feasibility, suitability with practical requirements, and harmony between the State, investors and land users.

Posting the draft Decree amending and supplementing a number of articles of Decree No. 44/2014/ND-CP regulating land prices on the Government Portal

The Deputy Prime Minister affirmed: Land price is a major policy of key nature in land policy, so amendments according to the shortened process are implemented in case of amendments to technical issues. The amended contents in the draft Decree have a great impact on socio-economic development, therefore, the Ministry of Natural Resources and Environment will receive opinions from ministries, branches, organizations, and experts at the meeting to finalize the Decree amending and supplementing a number of articles of Decree No. 44/2014/ND-CP of the Government on regulations on land prices; urgently collect opinions from ministries, branches, and localities; post on the Government's electronic information portal, of the Ministry of Natural Resources and Environment to consult with affected subjects to finalize and submit to the Government before August 25, 2023.
