Comprehensive review of Bao Son apartment building in Vinh City.

On October 17th, in response to VTC News, the leader of the Nghe An Provincial Inspectorate confirmed that the unit had established an inter-agency task force to comprehensively review the files and procedures of the Bao Son apartment project (located at 72 Le Loi Street, Vinh City) to report to the Nghe An Provincial People's Committee for consideration and handling in accordance with the law, with completion before October 31st, 2023.

Previously, VTC News reported on the Bảo Sơn apartment building (located at 72 Lê Lợi Street, Vinh City) allowing residents to move in before the construction had been officially inspected and approved.

The 30-story Bao Son apartment building is owned by Bao Son Investment, Construction and Tourism Group Joint Stock Company (headquartered in Hanoi). Although apartments were sold to residents many years ago, the project has yet to receive approval for investment, acceptance of the building's completion certificate, and residents have not yet been issued ownership certificates for their apartments.

The Bao Son apartment project was formerly the headquarters of Nghe An Salt and Trade Joint Stock Company (formerly known as Nghe An Salt Company - Nghe An Salt Corporation).

On November 30, 2015, Nghe An Salt and Trade Joint Stock Company (hereinafter referred to as the Salt Company) and Bao Son Investment and Construction Group Joint Stock Company (hereinafter referred to as the Bao Son Company) signed a contract for the transfer of assets attached to the land plot with a total value of VND 26 billion.

On November 13, 2015, Nghe An Salt Company sent official letter No. 332/2015/CV-TĐBS, stating that the company requested to return the land and the Certificate of Land Use Rights for the leased 4,342m2 to the People's Committee of Nghe An province and simultaneously requested the People's Committee of Nghe An province and the Department of Natural Resources and Environment to consider reallocating the land to Bao Son Company.

Subsequently, on April 19, 2016, the People's Committee of Nghe An province signed Decision No. 289/QQD-UBND.DC agreeing to lease the land to Bao Son Company.

Just one day later, on April 20, 2016, the People's Committee of Nghe An province continued to sign Decision No. 1720/QD-UBND-XD approving the detailed construction plan at a scale of 1/500 for the investment project to build a commercial service building, high-end apartments, and residential housing at 72 Le Loi Street, Vinh City.

Regarding the issuance of land ownership certificates for Bao Son apartment building (address: 72 Le Loi Street, Vinh City), Mr. Nguyen Cong Thanh, Deputy Director of the Land Registration Office (Nghe An Department of Natural Resources and Environment), stated that as of May 21, 2023, the Land Registration Office of the Nghe An Department of Natural Resources and Environment had not yet received the necessary documents from the investor to process the issuance of land ownership certificates to residents.

"According to regulations, the investor must submit the necessary documents for obtaining land ownership certificates for residents, but to date, the investor has not submitted the documents, so we cannot issue land ownership certificates to the residents," shared Nguyen Cong Thanh, Deputy Director of the Land Registration Office.

Chief Inspector Dinh Loan Hien of the Nghe An Department of Construction also confirmed that, as of now, the Bao Son apartment building has not yet been inspected and approved for use.

Regarding this issue, Mr. Nguyen Truong Son, Chairman of the Board of Directors of the company, admitted that the apartment building has not yet been officially inspected and approved. He stated that when residents bought the apartments and paid 95% of the price, they requested permission to renovate, remodel, and install interior furnishings, so the company agreed. However, after allowing residents to renovate, they ended up living there permanently.

“The reason the apartment building has not been inspected and approved is due to administrative procedural errors. The People's Committee of Nghe An province approved the detailed planning at a scale of 1/500, the Ministry of Construction approved the basic design planning and the technical construction design, and the Nghe An Department of Construction issued the construction permit. However, the People's Committee of Nghe An province should have issued a decision approving the investment policy first, and only after approving the investment policy should they have issued a decision approving the detailed planning at a scale of 1/500, and then proceeded with the subsequent steps. But they overlooked this initial step.”

"Since 2019, the Ministry of Construction has begun inspecting the project, but it has not been completed due to missing procedures. The Ministry of Construction requires the submission of the decision approving the investment policy for the project issued by the People's Committee of Nghe An province before acceptance can take place. However, from 2016 until now, the People's Committee of Nghe An province has not yet approved the investment policy, so our apartment building still cannot be inspected," added Mr. Nguyen Truong Son, Chairman of the Board of Directors of Bao Son Company.
