Removing obstacles to non-budgetary investment projects.

Currently, the province has 296 investment projects facing difficulties and obstacles, mainly related to land, site clearance, planning, and legal procedures. The province is resolutely reviewing and resolving these issues, prioritizing easier and larger projects first.

Most of them relate to the land sector.

Of the total number of projects still facing difficulties and obstacles, 254 are non-budgetary investment projects. Notably, among these non-budgetary projects, 123 are related to land issues. Similarly, in industrial parks, 31 out of 42 projects are facing obstacles related to land issues.

The main difficulties and obstacles relate to the conversion of annual land lease payments to one-time payments; compensation, land clearance, and land valuation; environmental permits, conversion of forest land use, conversion of land use, and land leasing; overlapping with approved mineral resource planning; and the lack of a detailed zoning plan. The project requires adjustments to the detailed planning to allocate 20% of the land for social housing as per regulations; the project has not completed land clearance but is not included in the list of projects requiring land acquisition; the project is not included in the housing development plan; lacks access roads; is hampered by construction planning; and has complicated investment procedures.

Many projects are facing legal obstacles related to construction procedures (due to the lack of regulations on approving the overall site plan, which previously belonged to the district level); procedures for adjusting investment schedules; and projects related to policies supporting investment in industrial park infrastructure for aluminum electrolysis projects.

Removing difficulties and obstacles

Currently, some projects face significant obstacles regarding compensation and land clearance, a task for which the State agency is responsible. Furthermore, land acquisition must ensure sufficient land for resettlement and relocation of affected households as stipulated in Clause 2, Article 912 of the 2024 Land Law. However, the available land for resettlement in many localities is currently very limited, leading to difficulties in compensation and land clearance.

Specifically for projects in the Tuyen Lam Lake National Tourist Area, in accordance with Decision No. 704/QD-TTg dated May 12, 2014 of the Prime Minister, Decision No. 1968/QD-UBND dated September 7, 2016 of the Provincial People's Committee on the general planning of the Tuyen Lam Lake National Tourist Area, and Notice No. 191/TB-VPCP of the Government Office dated July 22, 2016, strict closure of natural forests is required: the construction density and architectural indicators in some areas have been changed (for projects not yet completed, the density is reduced by approximately 40% compared to the approved plan in Decision No. 2117/QD-UBND).

Therefore, some investors in the Tuyen Lam Lake National Tourist Area have had to adjust their projects in terms of scale, architectural standards, etc., to comply with current regulations. Obstacles related to changing the land use purpose of forest land to other purposes have affected the initial investment goals and plans of the investors. In addition, some projects, according to previous plans, lacked access roads, making implementation difficult; in some cases, projects were terminated due to the lack of or impracticality of transportation options.

At a meeting to hear the Department of Finance report on the review of difficult and problematic non-budgetary investment projects in the province, Chairman of the Provincial People's Committee Ho Van Muoi requested that departments and agencies consider resolving difficulties and obstacles for projects, prioritizing easier projects first, larger projects first, and projects that need to be done first… The Chairman of the Provincial People's Committee requested the Department of Finance to review and provide complete information on projects in the past, present, and future; propose solutions, determine the authority of each level to resolve issues, and identify which issues need to be reported to the Standing Committee of the Provincial Party Committee and the Provincial People's Council…

On the other hand, the projects are divided into 6 areas, each overseen by a vice chairman, with directors of departments and agencies serving as permanent members… to directly guide and resolve difficulties and obstacles that the projects are facing. In particular, for projects that meet the criteria for revocation, the procedures for project revocation will be implemented.

Through a review, a total of 296 projects in the province are facing difficulties and obstacles, of which 228 fall under the jurisdiction of the Provincial People's Committee. The review also revealed that among these projects, 42 are located within industrial parks and 254 are outside. Accordingly, the Provincial People's Committee held a meeting to identify the difficulties and obstacles and agree on solutions; simultaneously, it committed to directing the resolution of each project in the coming period.
