The Ministry of Home Affairs regulates the procedures for confirming and resolving preferential treatment for people with revolutionary contributions and their relatives.
Specifically, according to Circular No. 09/2025/TT-BNV, the procedure for confirming and resolving preferential treatment for people with revolutionary contributions and their relatives in Article 26 of Circular No. 05/2013/TT-BLDTBXH dated May 15, 2013 of the Minister of Labor - Invalids and Social Affairs guiding the procedures for preparing records, managing records, and implementing preferential treatment for people with revolutionary contributions and their relatives is as follows:
The patient or relative submits a request for settlement of the regime with the following documents to the People's Committee at the commune level:
1. One of the following documents:
Medical transfer form, hospital transfer form; copy of party member's resume, military resume, police resume with full work history;
Certificate of operation in an area with particularly difficult socio -economic conditions issued by the Head of a competent agency or unit based on records, background and area of operation;
Decision on assignment to perform international duties issued by the Head of the competent agency or unit;
In case after discharge from the army, the old illness relapses, leading to mental illness and loss of capacity for action, the basis for confirmation from a competent authority according to regulations of the Ministry of National Defense and the Ministry of Public Security.
2. Documents issued during military service stating illness with a medical record of psychiatric treatment due to a relapse of an old illness from a provincial hospital or equivalent or higher.
In case after discharge from the army, the old illness relapses, leading to mental illness and loss of behavioral capacity, the basis is the medical treatment record of a provincial-level hospital or equivalent or higher.
3. Decision to demobilize or discharge.
In case there is no decision, there must be a certificate from the provincial Military Command or a competent authority as prescribed by the Ministry of Public Security.
According to the Circular, the People's Committee at the commune level, within 15 days from the date of receiving the application, is responsible for verifying and making a record requesting confirmation of sick soldiers with the above-mentioned documents and sending it to the provincial Military Command or the competent authority as prescribed by the Ministry of Public Security.
The provincial military command or competent authority as prescribed by the Ministry of Public Security shall, within 15 days from the date of receipt of all valid documents, be responsible for checking and issuing a certificate of service time in the army or police (in case there is no longer a decision on demobilization or discharge); forward the documents to the competent authority or unit to issue a certificate of illness as prescribed by the Ministry of National Defense or the Ministry of Public Security.
The competent authority or unit as prescribed by the Ministry of National Defense or the Ministry of Public Security is responsible for issuing a certificate of illness and referring it to the competent Medical Examination Council.
The competent authority of the Ministry of National Defense or the Ministry of Public Security shall, based on the minutes of the conclusion of the Medical Examination Council, issue a decision to issue a certificate of sick soldier and allowances and subsidies; and transfer it to the Department of Home Affairs where the sick soldier resides to implement the preferential regime.
This Circular takes effect from July 1, 2025.
