Land consolidation: Why is it still difficult?

- Concentrating and consolidating agricultural land on a large scale is the basis and condition for attracting individuals and businesses to invest capital, bring in modern machinery and equipment, and apply science and technology to commercial agricultural production, forming a value chain from production and processing to product consumption. This is also an important prerequisite for restructuring the agricultural sector. However, the process of land concentration and consolidation in most localities in the province is still slow and not truly effective.

High demand

Land is an extremely important means of production for cooperatives and businesses operating in the agricultural sector. However, in most successful businesses and cooperatives, this resource is still lacking.

The dairy farm of Ho Toan Joint Stock Company (Yen Son) still has a great need for land to expand its scale.

Ho Toan Joint Stock Company, located in My Bang commune (Yen Son district), is a leading enterprise in dairy farming and fresh milk production in the province. Each year, the company supplies 15,500 tons of fresh milk to the dairy processing industry, ranking among the top provinces in the Northern mountainous region.

Mr. Le Duc Do, Production Director, stated: "From an initial 500 dairy cows, the company has now grown to 2,700. The company's potential and resources allow for doubling or even tripling its current size, but this has been impossible. The main obstacle to expanding the farm is the lack of land." According to Mr. Do, because they cannot purchase or lease land to expand the barns, the company only keeps a small number of calves born each year to breed, while the rest must be sold due to lack of space. The shortage of land for expanding barns also means a scarcity of land for growing grass to feed the cows. The company aims to accumulate 50 hectares of land for grass cultivation by 2025, but currently, this figure is only 10%. To ensure a food supply for the cattle herd, Ho Toan Joint Stock Company has to buy corn from local farmers, and purchasing from farmers is not always easy in terms of both price and quantity.

Thanh Tuyen Investment and Construction Consulting Joint Stock Company, located at Group 13, An Tuong Ward ( Tuyen Quang City), is also facing obstacles in land consolidation for mulberry cultivation and silkworm farming. Mr. Pham Trung Nghia, the company's director, stated that the Silkworm Farming Association and many businesses have approached the company to place large orders for silkworm cocoons. However, the company is hesitant to sign contracts because the land available for mulberry cultivation – the silkworm's food source – is still insufficient to support large-scale farming. According to Mr. Nghia, the company has negotiated with local households to purchase land, but some are willing to sell, others are unwilling, and some only offer short-term leases. Mr. Nghia explained: "In the same field, some are selling, some aren't, and some only offer short-term leases. With a mulberry tree cycle of 3-5 years, businesses are reluctant to invest due to unavoidable risks."

Many cooperatives, despite their close ties with farmers, find it difficult to accumulate enough land to manage and produce independently. Mr. Tran Van Phuc, Director of Minh Tam Cooperative in Tu Thinh commune (Son Duong district), stated: "Minh Tam Cooperative really wants a large, contiguous plot of land to introduce mechanization into production, improve productivity and quality of agricultural products, and increase profits for members and workers. However, negotiating land leases with farmers is very difficult because some households agree while others do not. Therefore, the cooperative's melon cultivation area remains fragmented, with each locality and area having a separate plot, affecting harvesting and transportation."

Barriers to agricultural land accumulation

Land consolidation is considered the second step after land rearrangement and exchange, aimed at attracting individuals and businesses to invest capital, apply science and technology, and form commodity production along the value chain, contributing to the successful implementation of the province's agricultural restructuring plan. However, land consolidation for large-scale agricultural production is currently facing obstacles.

Ms. Tran Thi Binh, a lecturer specializing in land management at Tan Trao University, points out that: The majority of agricultural land is in the hands of farmers, and as long as the mentality of "the tiller owns the land" remains in their minds, even if the land is fragmented, small, and economically inefficient, they still want to hold onto it. In reality, many farming households, even with only 1-2 sao (approximately 1000-2000 square meters) of rice paddies, which yield almost no profit, still try to keep their land. Furthermore, with the current opening of many economic and transportation projects, the mentality of people holding onto their land and waiting for compensation opportunities is slowing down the process of land consolidation in many localities, especially in suburban areas.

Son Duong Sugar Corporation (Son Duong) is collaborating with local households to consolidate farmland and expand its raw material production area.

According to Master Binh, besides the two aforementioned obstacles, another factor hindering land consolidation is the land market's connection to the labor market, which is currently not functioning smoothly. The majority of rural workers entering the labor market are "informal," meaning they have no taxes, no insurance, and no contracts. The instability of the labor market means that the future of rural workers is uncertain. Therefore, even if they no longer farm, they still retain their land as a form of insurance, a place to return to production in times of difficulty, or, as a last resort, to mortgage, lease, or rent it out for money.

Comrade Nguyen Thanh Long, Deputy Head of the Provincial Department of Crop Production and Plant Protection, also raised issues affecting land consolidation by businesses. Specifically, some businesses lack strong links with farmers and cooperatives in production and product consumption, failing to meet market demands. The number of cooperatives directly involved in production, processing, and product consumption, or those linking production and consumption with farmers through contracts, is small and unsustainable. The situation of cooperative production without purchase, or with low-priced purchase, has occurred, eroding farmers' trust.

Remove the embankments and expand the development space.

Comrade Pham Manh Duyet, Member of the Provincial Party Committee, Director of the Department of Agriculture and Environment, affirmed: The policy of encouraging land consolidation and accumulation to improve agricultural production efficiency, apply scientific and technological advancements, and form specialized farming areas towards modern, specialized agricultural production linked to the market has always been a priority for the Party and the State.

On June 16, 2022, the 13th Central Committee of the Communist Party of Vietnam issued Resolution No. 19-NQ/TW on agriculture, farmers, and rural areas until 2030, with a vision to 2045. The resolution outlines tasks and solutions such as: promoting land consolidation and concentration; developing agriculture towards modern, specialized, large-scale commodity production, ensuring food safety based on the application of advanced science and technology, digital transformation, mechanization, and automation...

To remove obstacles affecting land consolidation and accumulation, and to ensure the development of modern, large-scale agricultural production, the Tuyen Quang Provincial People's Committee's Plan for implementing Resolution No. 19-NQ/TW of the Central Committee on agriculture, farmers, and rural areas until 2023, with a vision to 2045, dated April 17, 2023, includes land policies. Specifically, the province focuses on implementing mechanisms and policies to support the development of agriculture, farmers, and rural areas related to land, such as transferring land use rights, leasing land; contributing land use rights as equity to participate in large-scale agricultural production; using agricultural land flexibly and efficiently; and maximizing the mobilization of land resources to serve socio-economic development, ensure national defense and security, social stability, food security, and environmental protection. Effectively implement local land use planning and plans, land for the development of high-tech agricultural, forestry, and fisheries production areas, organic farming areas, and national forestry planning; prioritize land with business and service advantages for introducing and promoting agricultural products; develop concentrated agricultural production areas...

The State and provinces also have support mechanisms to help businesses investing in agriculture secure production space, as well as supplementing some policies and laws on taxes, exempting personal income tax for households participating in land consolidation through the transfer of land use rights...

The legal framework is clear; the important thing is to choose the appropriate form of agricultural land consolidation depending on the specific characteristics of each locality. In this process, all levels of government, organizations, cooperatives, businesses, and the people need to participate more strongly to remove embankments, form large-scale specialized farming areas, and improve agricultural production efficiency.

Facilitating land leasing for businesses and cooperatives.

In an effort to promote local economic development, Son Duong district has been actively implementing solutions to create favorable conditions for businesses and cooperatives to lease land. Many businesses have been facilitated in leasing land, such as JM Korean Agricultural Products Co., Ltd. and Kien Xuong Company.

To further facilitate land leasing for businesses and cooperatives, the locality has been reviewing and planning land resources in a transparent and open manner. In addition, simplifying administrative procedures and applying a "one-stop shop" mechanism helps minimize time and costs for investors. The district also focuses on investing in infrastructure, creating favorable conditions for production and business activities; promoting investment, and introducing the potential and advantages of the locality to investors inside and outside the province. Attractive investment incentives and support policies have also been developed to create motivation for businesses and cooperatives to invest.

Opportunities for green development

The Tuyen Binh Forestry Company Limited has been assigned by the Tuyen Quang Provincial People's Committee to manage 1,721.07 hectares of forest and forestry land. This land is concentrated in six communes of Yen Son district and Tuyen Quang city. This presents an opportunity for the company to develop its reforestation activities, creating large-scale, stable, and sustainable forestry production areas. This offers numerous advantages for the enterprise in developing long-term projects, establishing integrated raw material areas, and organizing production systematically. Concentrated production forestry is a crucial factor in enhancing the company's management capabilities, optimizing production processes, reducing costs, and increasing productivity, thereby generating greater added value. Furthermore, focusing on developing large forest areas opens opportunities for the company to participate in carbon credit markets, contributing to a green and sustainable development strategy.

A transparent monitoring mechanism needs to be established.

Currently, infrastructure such as transportation and irrigation systems still face many difficulties, which are also factors hindering the attraction of large-scale production investment. Land consolidation for sustainable agricultural development requires establishing a transparent monitoring mechanism to avoid negative practices during land transfer and consolidation.

Furthermore, it is necessary to organize propaganda and training programs to raise public awareness about the benefits of land consolidation and large-scale agricultural development. It is hoped that during the process of refining policies related to land consolidation, consideration will be given to creating more jobs and stable incomes for small-scale farmers or ethnic minorities.

We hope to ensure the rights of farmers are protected.

For each farming family, land is crucial for production and livelihood. Therefore, land consolidation must necessarily consider the harmonization of interests of both sides: those who contribute land and those who use it, with particular attention paid to the rights of farmers. Farmers must be guaranteed full payment of land rent and not lose their land in the event of changes. At the same time, farmers need to participate in and become laborers on the land their families contribute to the consolidation. Furthermore, when allocating land to businesses, individuals, or organizations for production, the agreed-upon production purpose must be followed to develop the agricultural and rural economy, avoiding situations where land is allocated only to be transformed into industrial zones, service areas, or even urban areas.
