
According to information from the Ministry of Finance , the agency is drafting a Decree detailing the application of disciplinary measures and compensation for damages related to wasteful practices and violations in the organization and implementation of waste prevention and control.
The decree aims to provide detailed regulations on the application of disciplinary measures, exemptions, and mitigations of disciplinary responsibility, serving as a basis for handling wasteful acts and violations in the implementation of waste prevention and control. Simultaneously, it provides detailed guidance on compensation for damages resulting from wasteful acts and violations in the implementation of waste prevention and control, including several methods for determining damages related to the consequences of wasteful acts.
Accordingly, the draft decree clearly states that those subject to disciplinary action include: Heads of agencies and organizations, and deputy heads of agencies and organizations who allow acts of wastefulness to occur in their respective agencies, organizations, units, enterprises, or areas under their management and supervision; and officials, civil servants, and public employees who commit acts of wastefulness or violations in the organization and implementation of waste prevention and control.
Wastefulness, despite being defined as a criminal offense, has received special attention from the Party and State over the years, as reflected in numerous resolutions, directives, and conclusions. However, identifying wastefulness in specific cases and handling violations remains quite challenging.
Previously, on December 10, 2025, the Director of the Supreme People's Procuracy , the Chief Justice of the Supreme People's Court, the Ministers of Public Security, National Defense, Justice, Finance, Industry and Trade, Construction, Agriculture and Environment, the State Auditor General, and the Government Inspector General jointly issued Circular No. 11, effective from January 25, 2026, guiding the determination of wastefulness for application in the initiation, investigation, prosecution, and trial of crimes related to wastefulness as stipulated in the Penal Code. Immediately after this circular came into effect, a Decree detailing the application of disciplinary measures and compensation for damages related to wasteful acts and violations in the organization and implementation of waste prevention and control was further developed.
Advances in the development of legislation related to the prevention and control of waste demonstrate the continuous and relentless efforts of relevant agencies to create a more complete and synchronized legal framework for strictly addressing violations related to waste. This also serves as a strong declaration of war against a scourge that is causing public outrage and eroding development resources.
