* According to the provisions of the Law on Environmental Protection 2020, Decree 08/2022/ND-CP, the mandatory recycling rate is the ratio of the minimum volume of products and packages that must be recycled according to the mandatory recycling standards to the total volume of products and packaging manufactured and brought to the market and imported in the year of responsibility. The mandatory recycling rate of each type of product and packaging is determined on the basis of the life cycle, disposal rate, and collection rate of the product or packaging; national recycling targets, environmental protection requirements and socio-economic conditions from time to time.
The mandatory recycling rate is adjusted every 3 years gradually to meet the national recycling target and environmental protection requirements. The compulsory recycling rate is adjusted by the Prime Minister and promulgated on September 30 of the last year of the 9-year cycle to apply for the next 3-year cycle.
Manufacturers and importers may recycle products and packages they produce, import or recycle products and packages of the same type manufactured or imported by other manufacturers or importers to achieve the mandatory recycling rate; Recycling imported scrap as raw production materials shall not be included in the compulsory recycling rate of manufacturers or importers. In case the manufacturer or importer recycles higher than the compulsory recycling rate, the difference shall be reserved for calculation into the compulsory recycling rate of the following years.
Also according to regulations, mandatory recycling standards are selected recycling solutions with minimum requirements on the amount of materials and fuel recovered for product and packaging recycling. Manufacturers and importers may choose one or more recycling solutions suitable to actual conditions.
* For tube and tire products
As a rule, the mandatory recycling rate for the first 3 years of tubes and tires is 5%.
Regulations on recycling of tubes and tires are: Recover at least 40% of the volume of products and packaging to be recycled according to the required recycling rate.
Selected recycling solutions include: High-tech gluing tires according to manufacturer's standards; Cutting and recovering rubber powder as aggregate; Fractional distillation to oil.
