Regarding violations of construction regulations in Thach That district ( Hanoi ), including the 9-story building with nearly 150 illegally constructed apartments (in Tan Xa commune) that the press has reported on in recent days, the Inspectorate of the Department of Construction is currently working with the Thach That district authorities to clarify the violations and handle them according to the directives of the Chairman of the Hanoi People's Committee.
A responsible official from the Hanoi Department of Construction stated that the handling of construction violations for this 9-story building falls under the authority of the Chairman of the Thach That District People's Committee.
According to this official, Decision 04 on Regulations for managing construction order in Hanoi assigns the People's Committees of districts and communes the responsibility for comprehensive management.
If violations occur, the ultimate responsibility for managing construction order at the local level rests with the Chairman of the District People's Committee. Regarding the construction order violations at the 9-story building in Tan Xa commune, the Chairman of the Thach That District People's Committee bears full responsibility.
This building was licensed for 3 floors plus a rooftop extension. The construction area of the first floor is over 150 m2.
Responding to the press, Mr. Nguyen Minh Hong, Chairman of the People's Committee of Thach That District (Hanoi), affirmed that this construction project was illegal and would be dealt with as an example for other projects. However, while saying that the punishment would be strict and serve as an example, the head of the Thach That district government did not specify exactly how strict it would be.
According to the Chairman of the People's Committee of Thach That District, this violation is primarily due to the failure of officials and agencies entrusted with the authority to fulfill their responsibilities. The district has established inspection teams and issued Conclusion No. 13 to review and handle disciplinary actions against a number of commune-level officials. Next week, the district will impose disciplinary measures on the Chairman, Vice Chairman, land administration officials, and specialized officials of the communes involved in the violations.
The Chairman of the People's Committee of Thach That District has not yet provided information on whether he or any other leader of Thach That District will be held responsible for the numerous illegal constructions in the district.
According to Nguoi Dua Tin 's investigation, construction permit No. 32, signed by Mr. Nguyen Kim Loan - Vice Chairman of the People's Committee of Thach That District - for Mr. VMC and Ms. NTQH (residing in Viet Hung Ward, Long Bien District), indicates that this is a private residential building on plot No. 152, map sheet No. 14 (village 1, Tan Xa commune). The plot has an area of 726.5 m2.
Despite not having a construction permit, the investor proceeded with construction and was subsequently fined. The Thach That District People's Committee then granted the investor a construction permit for a 3-story building with a penthouse; the building density was only 20.7%; and the height was only 15.6 meters from the existing road level.
However, the developer subsequently built a 9-story building with nearly 150 apartments, covering almost the entire 700 m2 area. Thach That District then revoked the construction permit. Currently, the building is operating without a permit.
Refer the case to the investigating agency if there are signs of criminal activity.
Previously, regarding this project, the Chairman of the Hanoi People's Committee, Tran Sy Thanh, requested the Department of Construction to take the lead and coordinate with the City People's Committee Office and the Thach That District People's Committee to inspect and clarify the matter; consider the responsibility of collectives and individuals (if any) in accordance with Directive No. 24 dated August 7, 2023, of the Standing Committee of the City Party Committee "On strengthening discipline and responsibility in resolving work in the political system of the City"; in case there are signs of violations of criminal law, transfer the case to the investigating agency for handling according to its authority .
